<br />																			•EASEMENT AND AGREEMENT
<br />    					This Agreement made and entered into by and between  Kenneth  F.  Armstrong
<br />       	and  Lydia Armstrong,  husband  and wife,  each  individually  in nis  ant' -her  own
<br />       	right  and  as  spouse  of  the  other,  				of    Hall
<br />     			County, Nebraska, hereinafter known as the "Grantor   s   " and Northwestern Public
<br />     			Service Company, a Delaware Corporation, Huron,  South Dakota, hereinafter known
<br />     			as the "Grantee"
<br />    					WITNESSETE
<br />    					WHEREAS the Grantor  s     	are       the owners    of the following
<br />     			described tract of real property situated in  	Hall    			County,
<br />    					A  tract  of  land  commencing  363  feet  North  of  the  Southeast  corner
<br />     			Nebraska:  of  the  Southeast  Quarter  of  the  Northeast  Quarter  (SE :NE4)   of
<br />     	Section Thirty-three  (33) ,  Township Eleven  ( 11 ) ,  North,  Range  Nine  (9) ,  West  of
<br />     	the  6th  P .  ,J;.  in Hall  `-ounty,  Nebraska;   thence  in  a  Westerly  direction  to  the
<br />     	West  line  of  said  Southeast  Quarter  of  the  Northeast  Quarter  (SE4NE4) ,  thence  in
<br />     	a  Northerly  direction  along  said  'West  line  a  distance  of  264  feet,   thence  in  an
<br />     	Easterly  direction  parallel  with  the  South  line  of  said  Southeast  Quarter  of  the
<br />     	Northeast  Quarter  ( SE4NE4)  to  the  East  line  thereof,  thence  in a  Southerly  dir-
<br />     	ection  264  feet  to  the  place  of  beginninc,  containing  eight  acres,  a  little  more
<br />     	or  less,   said  eight  acre  tract  lying  immediately  North and  adjacent  tosLite  three
<br />   																	•
<br />     	acre  tract  heretofore  sold  to  L.  W.  Martin,
<br />    					WHEREAS the Grantee is desirous of laying and installing a gas main
<br />     			or mains and equipment to run approximately	North  	and   South
<br />     			through the       'ast      	side of said tract of land at a point approximately
<br />      			forty-two    	feet      West      	of the  East  		boundary line of
<br />     			said tract.
<br />    					NOW THEREFORE for and in consideration of the sum of One Dollar ($1.00)
<br />     			in hand paid by the Grantee to the Grantor  S     ,  the receipt of which is hereby
<br />     			acknowledged,  the said Grantor S	for  themselves 		their
<br />     			heirs,  executors,  administrators,  successors,  lessees,  and assigns do
<br />    			hereby give and grant unto the Grantee, its successors,  lessees, and assigns,  a
<br />    			perpetual easement and right of way through,  along and across a strip of land
<br /> 				Six   	feet wide in the following described tract of land situated i
<br />     											A  tract  of  land  commencing  363  feet
<br />       				Hall      		County  Nebraska,: North  of  the  Southeast  corner  of  the
<br />     	Southeast  Quarter  of  the  Northeast  Quarter  (SE4NEg)  of  Section  Thirty-three  (33) ,
<br />     	Township  Lleven  ( 11) ,  North,  Range  Nine  (9) ,  West  of the  6th  P.  M.  in tall  county,
<br />     	Nebraska;  thence  in  a  Westerly  direction  to  the  West  line  of  said  Southeast
<br />     	Quarter  of  the  Northeast  Quarter  (SE4NE4) ,  thence  in  a  Northerly  cd  rection  along
<br />     	said  West  line  a  distance  of  264  feet ,  thence  in  an  Easterly  direction  parallel
<br />     	with  the  mouth  line  of  said  Southeast  Quarter  of  the  Northeast  Quarter  ( SE4NE4)
<br />     	to  the  Last  line  thereof,   thence  in  a  Southerly  direction  264  feet  to  the  place
<br />     	of  beginning,  containing  eight  acres,  a  little  more  or  less,  said  eight  acre
<br />     	tract  lying  immediately North  and  adjacent  to  the  three  acre  tract  heretofore
<br />     	sold  to  L.  W.  Martin.
