<br /> continuity of. ownerahip and management of their Gorporatfons -
<br /> and of the real estate wh�ch they now own as Tenr�nts in -
<br /> Common or wi11 hereafter own as Tenants in Corc�n, eaah does
<br /> hereby voluntarily enter this Agreement in reliance upon the
<br /> mutual promises and agreements herein expreased:
<br /> WHERE:EORE, in consideration of their mutual promises
<br /> and agreer.i�nts and in reliance upon the promi.ses and agree-
<br /> ments af each of the others, the undersigned do hereby
<br /> promise, covenant and agree as follows:
<br /> ARTICLE I
<br /> Definitions
<br /> As used in this Agreement the following terms mean:
<br /> 1. The Mettenbrink Company means a Nebraaka corpo-
<br /> ration in which Gary Mettenbrink, �ohn Mettenbri.nk� Lynn
<br /> � Mettenbrink and Caro1 Mettenbrink York are equal snareholder�
<br /> and a.re the only shareho].ders.
<br /> 2. 4M Agricu].tura� Associaties, Inc. means a Nebraska
<br /> corporation in which G�ry Mettenbrink, John Mettenbrink,
<br /> Lynn Mettenbxink and Garol Mettenbrink York are equal share-
<br /> holders and are the only shareholders.
<br /> 3. Mettenbrink Farms, Inc. , means a Nebraska corpo-
<br /> ration in which Gary Mettenbrink, John Mettenbri nk, Lynn
<br /> Mettenbrink and Carol Mette�ibrink York are shareholders and
<br /> - in which their mother, Arlene Mettenbrink, is al so a share-
<br /> holder.
<br /> . 4. The Family Corporati.ons means all thre� (3) of the
<br /> corporations named in paragraphs 1, 2 and 3 oE this �,rticle.
<br /> 5. The Real Estate means all of the right, title,
<br /> claim and interes�, whether now owned or hereafter acquired,
<br /> � of each of Gary Mettenbrink, John Mettenbrink, Lynn Metten-
<br /> brink and Carol Mettenbrink York in and to �he following
<br /> � described real estate:
<br /> � The Southeast Quarter (SE�) , the East Half o£ 'the
<br /> Southwest Quarter (E�SW�) , and the Northeast
<br /> � Quarter (NF::) of Section Three (3) , Township
<br /> " Eleven (11) North, Range Ten (10) West o� the 6�h
<br /> P.M. , Hall County, Nebraska, except that portion
<br /> deeded to Southern Nebraska Rural Public Power
<br /> District in Warranty Deed recorded in Bonk 164,
<br /> � Page 409.
<br /> ' It is specifically underst�od that one-half (�) of the above
<br /> �pacri4�ad real estate is now in Trust uncier the Last Will
<br /> - and Testament of Iienry Mettenbrink, deceased, and that if
<br /> - and when any interest is conveyed from the Trust to any o£
<br /> - the undersigned, then that interest falls under and becomes
<br /> - subject to the terms of this Agreement without �ny fur.ther
<br /> - action on the part of anyone.
