<br />  		This  matter  coming  on  to  be  heard  this  22nd  day  of  .October,  194'�,  on  the  Petition  of  Effie
<br />	Burne��  Hamma.ch�r,   surviving �ridow  of  the  abo�e  na�ed  deceased,   the  said  Petition  havin�  been  sub-
<br />	mitted  to  this  Court  for  the  purpose  of  determinin�  the  heirship  of  and  the  ri�ht  of  d�scen�  to
<br />	real  estate  owned  by  the.  above  named  deceased;  and  the  Cour�G  having  examined  the  files  and  ha.v3.ng
<br />	found  that  due  and  proPer  notice  had  been  served  by  publication  as  provided  by  law  a:nd  that  '�he
<br />	Court  had  �urisdiction,  �roceeded  to  the  taking  of  testimony.
<br />  		Upon  the  evidence  adduced  THE  COURT  FINDS  that  (�eorge  W.  Burnett  departed  this  li�e  on  �he
<br />	16th  day  of  December  1916,  he  being  a�  that  time  a  resident  of  Hal1  County,  Nebraska,  and  being
<br />	the  owner  in  fee  sir�ple  at  �he  time  of  his  death  of  the  fal�owing  described  r�al  property:
<br />  		Lots  Six  (6)  and  Seven  (7) ,   in  Block  l�ineteen  (i9) ,  of  Packer  and  Barr� s  Second  Addit3.on  to
<br />	the  City  of  Grand  Island,  Nebraska; 													�
<br />	Tha.t  no  administra�ion  has  been  had  on  '�he  eatate  of  the  above  named  deceased;   '�hat  more  than  two
<br />	years  have  elapsed  since  the  death  of  George  W.  Burnett,  and  that  a  determination  of  heirship  is
<br />	necessary.      �
<br />  		THE  COURT  FURTHER FINDS  that  the  deeeased  3.eft  surviving  the  ��etitioner,  Effie  Burnett  Ham-
<br />	macher,  his  widow;  Boyd, Burnett,  a  son;  Ruby  Burne�t  Loop,  a  daughter;  and  Del�a  Burnett  Boltz,  a
<br />	daught�r;   that  the  deceased  Ieft  no  Last  Will  and  Testament  and  that  under  the  laws  of  de�cent  of
<br />	the  State  of  Nebraska,   said  prorerty  did  pass  and  deseend  as  follows:

<br />     			Boyd  Hurnett,   son   			)
<br />     			Ruby  Burn�tt  Loop,  daughter      )-  each  an  undivided  2/9  interest

<br />	That  Effie  Burnett  Hammacher,  widow  of  the  decaased,  resided  in  the  premises  with  �he  deceased
<br />	during  hi�  lifetime  and  ha4  resided  there  since,  and  that  sa�.d  Effie  Burnett  Hammacher  has  a  home-
<br />	stead.  interest  in  the  prem�.ses.
<br />   		TT  IS,  THEREFORE,   ORDERED  ADJUDGED  AND  DECREED  BY  THE  COURT  that  the  sole  and  only  heirs  of
