<br />In the matter of the estate of
<br />Final Decree.
<br />Joseph Zoth, deceased.
<br />Now on this 23rd day of June, 1911, this cause came on for hearing upon the final j
<br />report of Cecilia Zoth, AdminiSlmtria of the estate of Joseph Zoth, deceased, _:and it appearing
<br />i
<br />to the satisfaction of the Court, from the proof now on file, that all persons ' interested in the
<br />estate of said deceased have been duly notified by publication as required by the, order of court
<br />dated June 10, 1911, of the filing of said report and of the time and place fixed for the hearing,
<br />thereon, and no one appearing to object, and there being no objections or protest on file, and
<br />it further appearing to the Court, after a full examination thereof that said report is correct
<br />in all respects and ought to be approved and 'allowed, it is, therefore,
<br />Ordered, Adjudged and Decreed that the report of Cecilia Zoth, administratrix, be and the
<br />same hereby is approved and allowed as and for her final account and she is discharged of her
<br />trust and her bond released.
<br />The Court finds that the said administratrix has paid the fun -
<br />eral expenses, the expenses of administering the estate and has fully accounted for all of the
<br />i
<br />estate which came into her possession, and that there remains nothing in her hands for distrib-
<br />ution.
<br />The Court finds trat due and legal notice was riven to all creditors of the deceased
<br />of the time allowed and place appointed for filing claims against his estate; that the time
<br />i
<br />limited for filing claims has fully expired; that all claims filed and allowed against said
<br />estate have been fully paid and satisfied and that claims and demands outstanding against the
<br />I
<br />estate of Joseph Zoth, deceased and not filed, if any such there be, are therefore forever bar-
<br />red and excluded.
<br />It is therefore ordered adjudged and considered by the Court that all persons
<br />are forever barred from filing or setting up any claims against the estate of Joseph Zoth, de- �
<br />ceased, and said estate is fully settled and closed.
<br />The Court finds that the said
<br />i
<br />Joseph Zoth left surviving him as his heirs at law, and his only heirs at law, the following
<br />named persons: Cecilia Zoth, his widow, and John Zoth, his son.
<br />i
<br />The Court finds that the said Joseph Zoth, deceased, was at the time of his death the owner
<br />1
<br />of the following described real estate situate in the County of Hall and State of Yebraska, to
<br />wit: The West one -half 0) of Lot Four (4) of the County Subdivision of the West one -half
<br />(z) of the Southwest quarter (5.71.4) of Section Ten (10), Township Eleven (11), Range Nine (9)
<br />i
<br />City of Grand Island, and that under and by virtue of the law-,of descent of the State of Neb-
<br />raska said real estate did pass and descend at his death, intestate, in the manner following: �
<br />One -half of said real estate to Cecilia Zoth and One -half thereof to John Zoth.- all subject
<br />- j
<br />to the homestead right of the said Cecilia Zoth in and to said real estate.
<br />It is therefore 1010MIDERED by the Court that the west I of Lot 4 of the County Subdivision
<br />i
<br />of the Nest J of the 5.-A.4 of Section 10, Township 11, in Rahge 9, in Hall County, Nebraska,
<br />I
<br />in the City of Grand Island, did pass and descend at the death of Joseph Zoth, intestate, to
<br />i
<br />Cecilia Zoth and John Zoth , in equal shares , subject to the homestead rights of the said Cecilia
<br />I
<br />Zoth in said property.
