Unless an agreem�t is made in writing or Applic�ble Law <br />requires inYerest to be paid on such insuranc� proceeds, Lender shall not be required to pay Borrower any <br />interest or eamings an such proce�eds. Fees for public adjusters, or other third partieg, retained by <br />Borrower shall not be paid out of the insurance proceeds and sha11 be the sole obligation of Borrower. If <br />the resta�ation or repair is not e�onomically feasible or Lender's security would be lesssn�, the insurance <br />proceeds sha11 be applie� to th� sums secured by this Sacarity Instcvment, whether or not then due, with <br />the excess, if any, Paid to Bonower. S�ch insurance proc,eeds aha11 be appliefl in the order provided for in <br />Se�tion 2. <br />If Bono� abandons the Property, Lender may file, negotiate and settle any available insuraace <br />claim and relate� anatters. If Borrower does not respond within 30 days to a notice fram Lender that tha <br />insurance c�rier has o��ad to settle a claim, then Lender may negotiate and settle the claim. The 30-day <br />period vvill begin wh� the notice is given. In either event, or if Lender acquires the Propert�r under <br />Section 22 or otheiwise, Borrower hereby assigns to Lender (a) Boirower' s rights to any insuranc;e <br />proc�ds in an am+ount not to exxc�ed the amounts unpaid under the Note or this Seanrity Instrunnent, and <br />(b) any other of Borrower's rights (other than the right to any refinnd of �nad premiuma paid by <br />Borrower) under a11 insiu�ance policies covering tha Properiy, insofar as such rights are applic�ble to the <br />coverage of the Property. Lender may use tha insurance proceeds either to repair or restore the Property or <br />to pay amounts empaid under the Note or this Security Instrument, whether or not then due. <br />6. Occ�ancy. Boaower shall occupy, establish, and u� the Property as Boaowea�'s princiPal <br />residence within 60 days aftei° the execution of t1�is S�urity Instcvment and shall continue to ac�upy tha <br />Properiy as Borrower° s principal residence for at least one yeaz after tha date of axupancy, unl�s Lender <br />otherwise agrees in writing, wluch consent shall not be unreasonably withheld, or unless extenuating <br />circumstances exist which are Ueyond Borrower' s control. <br />7. Preservadon, Maintenance and Protection of the Property; Inspecbions. Borrower shall aot <br />deslroy� damage or impair the Property, allow the Property to deteriorate or cammit waste on tha <br />Property. Whether or not Boaower is residing in the ProPerh', Borrower shall maintain the Properiy in <br />order to prevent the Property from deteriorating or decreasing ia value due to its condition. iJnless it is <br />determined pursuant to Sect►on 5 that repair or restoration is not ecanomically fe,asi`ble, Bonower shall <br />prompfly repair the Property if damaged to avoid further deterioration or damage. If insurance or <br />condemnation proceeds aza paid in connection with datnage to, or the taking o� the Progerty, Boaower <br />shall be responsi'ble for repairing or restoring the Property only if Lender has released proc�eds for such <br />purposes. Lend�r inay diaburse proceeds for tha repairs and restoration in a single payment or in a series of <br />progress payments as the work is completed. If tha insuranca or condemnation proceeds are not sufficient <br />to repair or restore the Properiy, Borrower is not relieved of Borrower' s obligation for the completion of <br />such repair or regtoration. <br />Lender or its �gent may make reasonable enlries upon and inspections of the Prope�y. If it has <br />reasonable cause, Lender gnay inspect the interior of the improvements on the Property. Lender shall give <br />Borrower notice at the time of or prior to such an interior inspection specifying such reasonable cause. <br />8. Borrower°s Loan Application. Borrower shall ba in default if, during the Lo� applic�tion <br />process, Borrower or any persons or entities acting at the direcrion of Borrower or with Bonower's <br />knowledge or consent gave materially false, misleading, or inaccurata informaYion or statements to Lender <br />(or failed to proeide Lender with material information) in connection with the Loan.
