Baack, Attornev at I.aw ,as trustee for <br /> thebenefitof ThP Overland 11'ational �3ank of Grand Island ,asbeneficiary, <br /> securing payment of a promissory note in the principal amount of$ 40,000.00 .That prior trust deed was recorded on <br /> June 24 , 1997 with the Recorder of Hall County, Nebraska in Book <br /> 97-104936 page <br /> TO HAVE AND TO HOLD the same,with all rights,privileges and appurtenances to such Property belonging unto Trustee,and executors, <br /> administrators,heirs,successors and assigns for Trustee forever.And Trustor in this Trust Deed expressly waives,releases and relinquishes <br /> unto Trustee all right,title,claim,interest,benefit and estate whatever,in and to the Property which is given by or results from all laws of <br /> the State of Nebraska pertaining to the exemption of homestead.And Trustor covenants with Trustee that he will forever warrant and <br /> defend the title to the Property against the lawful claims of all persons whomscever. <br /> IN TRUST HOWEVER,for the purposes described,as follows:Trustor on this date has executed a promissory Note or Loan Agreement � <br /> (hereafter"Agreement"),which evidences a loan in the Actual Amount of Loan of$ 8 4 5 4.7 9 (hereafter referred to <br /> as the"Principal"),together with interest on unpaid balances of the Principal from time to time outstanding at the Rate of Charge set forth <br /> in the Agreement,the Final Due Date being Anril 13 , 2003 ,all of which is payable at the o�ce of Beneficiary. <br /> Until the filing of a Notice of Default,Trustor shall:(1)pay all present and future taxes and assessments,general and special,against the <br /> Property before the taxes become delinquent or actionable; (2) keep the structures located on the Property securing this loan insured <br /> against damage caused by fire and other physical hazards, name Beneficiary a loss payee and deliver to Beneficiary a loss payable <br /> endorsement. If insurance covering the Property is cancelled or expires while the loan is outstanding and Trustor does not reinstate the <br /> coverage,Beneficiary may obtain,at Beneficiary's option,hazard insurance coverage protecting Beneficiary's interest in the Property. <br /> Trustor authorizes Beneficiary,at Beneficiary's option,to obtain coverage on the Property in an amount not greater than the outstanding <br /> balance of principal and interest on the loan or,if known to be less,the replacement value of the Property,in the event that Trustor fails to <br /> maintain the required hazard insurance or fails to provide adequate proof of its existence.Trustor authorizes Beneficiary to chazge Trustor <br /> for the costs of this insurance and add the insurance charges to the unpaid balance of the loan which accrues interest at the Rate of Chazge. <br /> The addition of the insurance chazges due might increase the amount of Trustor's final instalment.The cost of Creditor Placed Hazazd <br /> Insurance might be higher than the cost of standard insurance protecting the property. The Creditor Placed Hazazd Insurance will not <br /> insure the contents of the Property or provide liability coverage.T'he insurance might not be the lowest cost coverage of its type available <br /> and Trustor agrees that Beneficiary has no obligation to obtain the lowest cost coverage. Beneficiary or an affiliated company might <br /> receive some benefit(i.e.commission,service fee,expense reimbursement,etc.)from the placement of this insurance and Trustor will be <br /> chazged for the full cost of the premium without reduction for any such benefit.If at any time after Beneficiary has obtained this insurance, <br /> Trustor provides adequate proof that Trustor has subsequently purchased the required coverage, Beneficiary will cancel the coverage <br /> Beneficiary obtained and credit any unearned premiums to Tru9tor's'�1"an,and(3)pay and comply with all the terms and conditions of any <br /> lien,claim or indebtedness that may be senior to or take precedence of this Trust Deed as soon as any such payment on or of such lien, <br /> claim or indebtedness shall become due.Upon failure of Trustor to keep any agreements made in this Trust Deed,Beneficiary may pay <br /> accrued taxes and insurance premiums or pay off�y liens or claims or indebtedness, as the case may be.The money so expended by <br /> Beneficiary for this purpose shall bear interest at the Rate of Charge and shall be secured by this Trust Deed.Trustor agrees to repay the <br /> same upon demand. Upon failure so to do, the loan immediately shall ecome due and payable, at the option of Beneficiary.
