<br /> _ KNOW ALL N BY THESE PRESEMS:
<br /> THIS INDENTURE, made this day of March, 1959, between William P. Mullen,
<br /> Executor of the Last Will and Testament of John J. Hannon� also known as J. J. Hannon, ,
<br /> of Hall County, Nebraska, deceased, party of the first part and MARVIN KOEPP and I
<br /> MARIAN KOEPP of Hall County, Nebraska, parties of the second part.
<br /> WHEREAS, by the Last Will, dated Jvly 21, 1951� the said John J. Hannon, also
<br /> known as J. J. Hannon appointed the said Plilliam P. Mulien, party of the first part,
<br /> as Executor thereof, and
<br /> WHEREAS, the said Testator died on the 27th day of Avgust, 1958, and his said Will
<br /> was on the 6th day of October, 1958, duly approved and allowed by the Probate Court of
<br /> the said County of Hall in the State of Nebraska, and the said Executor duly qualified
<br /> as such by putting up a One Hundred Thousand Doilar ($100,000.00) Surety Bond for the
<br /> faithful performance of his duties as such Executor, and said bond has been duly approved
<br /> by the County Judge of Hall County� �lebraska; and
<br /> WHEREAS, under and by virtue of the terms and conditions of the Last Wiil of the
<br /> said John J. Hannon, also known as J. J. Hannon, deceased, the said Executor was author-
<br /> ized and directed within one year from the date of the death of said Testator to sell all
<br /> of the real estate of said decedent including the real estate hereinafter described and
<br /> to make good and sufficient deeds of conveyance, such deeds to have the same validity and
<br /> effect as if made, signed, sealed, executed, acknowledged, and delivered by the said
<br /> Testator personallp, and that said sales could be made at either public or private sale,
<br /> whichever in the jvdgment of said Executor was for the best interest of said estate; and
<br /> whereas, the said Executor, being the first party, decided to sell said real estate at
<br /> public auction, and having in all things fully complied with the terms and conditions of
<br /> said Last 'vYill and Testament of said John J. Hannon, did on the 6th day of November, 1958,
<br /> at 2:00 P.Nf, of said day, sell by public vendue the real estate hereinafter described to
<br /> MARVIN KOEPP and MARIAN KOEPP, of Hall County, Nebraska, for the sum of Twenty-four
<br /> Thousand, Eighty Dollars and no/100 ($24,080.00), they being the highest bidder therefor.
<br /> Now, this indenture, witnesseth, that in the exercise of the power to William P.
<br /> Mullen, given by the said Last �Yill and Testament of John J. Hannon, deceased, and every
<br /> other power him hereunto enabling, and in the consideration of the sum of $24,080.00 to
<br /> him in hand paid by the party of the second part, the receipt of which is hereby acknow-
<br /> ledged by the said party of the first part, Executor as aforesaid, does hereby grant,
<br /> bargain, sell, and convey unto the said MARVIN KOEPF and MARIAN KOEPP, husband and wife,
<br /> as tenants in common, the following described real estate viz;
<br /> The South Half o: the North East Quarter
<br /> (S�NNE4) of Section Twenty-one (21), Town-
<br /> ship Ten (10) North, Range Twelve (12),
<br /> West of the 6th P.;u;.
<br /> Subject to an oil lease in favor of B. F. Phillips, Jr. Recorded in Book "X" at
<br /> Page 579 in the Office of the Register of Deeds of Hall County, Nebraska.
<br /> Together with all of the tenements, herediaments, and apourtenances to ±he same belonging
<br /> and all the Estate, Right, Title, Interest, Claim or Demand whatsoever of the said John
<br /> J. Hannon, of, in, or to the same, or any part thereof.
<br /> TO HAVE AND TO HOLD the above described premises with the appurtenances, unto the
<br /> said MARVIN KOEPP and MI►RIAN KOEPP, husband and wife� as tenants in common, and to their
<br /> heirs, and assigns forever, and I, the said 'Nilliam P. Mullen, as cxecutor of the Last
<br /> Will and Testament of John J. Hannon, also known as J. J. Hannon, hereby covenant with
<br /> the said MARVIN KOEPP and MARIAN KOEPP, and as Executor� I have sold said premises with
<br /> a good and perfect titie, svbject only to the oil lease hereinbefore described; that
<br /> under the terms and conditions of the Last Will and Testament of said John J. Hannon, I
<br /> have good right and awfuZ authority to sell and convey same; that they are free and clear
<br /> of all liens a brances whatsoever.
