6. No soa, earth, sand, gravel or trees shall be removed from such <br /> tract to the injury of the value o� the appearance thereof, and no unused <br /> building material, junk or rubbish shall be left exposed on such tract ex- <br /> cept during actual building operations. <br /> 7. No cesspool ( s) shall be constructed, installed or maintained or <br /> permitted in or upon any lot, No foul waste water or refuse or garbage <br /> or sewerage of any kind shall be permitted to be disposed of in or upon <br /> the soil or sand of any lot. till sewerage shall be conaucted through <br /> pipes or wholly enclosed drains to an adequate ana efricient septic tank <br /> or chemical aisposal receptacle which shall not pe closer than twenty- <br /> five (25) feet to any lot line of the lot on which it is installea. All <br /> disposal systems must be inspected ana approvea by the liepartment of Health, <br /> of the State of Nebraska, or local board or uepartment o� Health having <br /> lawful jurisaiction thereof. <br /> 8. No worn out or discaraea automobiles, machinery or parts thereot, <br /> shall be storea on such tract ana no part thereor snail be used for <br /> discarded automobiles, macninery, junk piles, or other storage of any <br /> kind of junk or waste material. <br /> 9. No manufacture of any sort, or storage of material or activity <br /> of any offensive, dangerous, noxious or oaorous nature, shall be permitted <br /> operated, or conaucted upon the tract. <br /> 10. The foregoing covenants, restrictions and conditions are to run <br /> with such lands and shall be binding upon all persons and all parties <br /> claiming ownership thereof until January 1, 1999. <br /> 11. If the above named Grantees, his, her, or their heirs or assigns, <br /> shall violate, any of the covenants, restrictions, or conditions, herein <br /> above set forth, it shall be lawful not only for the Grantor herein and <br /> her successors and assigns, but also for the owner or owners, deriving <br /> title from or through the Grantor herein, of any tract or tracts adjoining <br /> in the neighborhood of the tract herein conveyed to prosecute any pro- <br /> ceedings at law or in equity against the person or persons violating or <br /> attempting to violate any of the above covenants, restrictions or conai- <br /> tions, and to prevent him or her from so doing, or to recover damages for <br /> such violations, Provided, that a breach of any such conditions, restrictions, <br /> or reservations shall not defeat or render invalid the lien of any mortgage <br /> made in good faith for value as to any such lot, and, Provided, further, <br /> that such conditions, restrictions and reservations shall remain at all <br /> times in full force and effect as against any owner of any lot for reason <br /> Page 2 <br />
