<br />LAKE HERITAGE SECOND SUBDNISION AN ADDITION TO THE CITY OF GRAND
<br />ISLAND, NEBRASKA
<br />THIS DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND
<br />CONDITIONS is made effective as of this 18th day of May, 2011, by and among DORALENE
<br />F. NIEDFELT, Trustee of the Doralene F. Niedfelt Revocable Trust dated August 22, 2001 and
<br />amended and restated in its entirety on December 26, 2003; ERIC D. MUTH and EMILY C.
<br />MiJTH, husband and wife; ANDREW W. MEIER and NICOLE M. MEIER, husband and wife;
<br />KURT F. MCCALLiJM and SHIRLEY M. MCCALLUM, husband and wife; LYNN M.
<br />MAYHEW and AMY L. MAYHEW, husband and wife; and TODD A. CARPENTER and
<br />DEBORA S. CARPENTER, husband and wife, hereinafter collectively referred to as
<br />"Declarant" (whether one or more), for themselves, their successors, grantees and assigns:
<br />KNOW ALL MEN BY THESE PRESENTS:

<br />DECLARATION OF PURPOSE
<br />The purpose of this DECLARATION OF RESTRICTIVE COVENANTS,
<br />RESTRICTIONS AND CONDITIONS is to declare the desire of Declarant to improve Lake
<br />Heritage Subdivision, an addition to the City of Grand Island and Nebraska Lake Heritage
<br />Second Subdivision, an addition to the City of Grand Island, Nebraska by encouraging the sale
<br />of lots and the construction of single family residences thereon.
<br />In furtherance of this purpose, Declarant hereby declares that the lands described
<br />hereinbelow in Article II shall be held, sold and conveyed subject to the following reservations,
<br />easements, limitations, restrictions, servitudes, covenants, conditions, charges and liens,
<br />(hereinafter collectively termed "covenants and conditions"), which are for the purpose of
<br />protecting the value and desirability of the lots herein described comprising Lake Heritage
<br />Subdivision, an addition to the City of Grand Island, Nebraska and Lake Heritage Second
<br />Subdivision, an addition to the City of Grand Island, Nebraska as duly recorded in the Office of
<br />the Hall County Nebraska Register of Deeds. These covenants, conditions, reservations and
<br />restrictions shall run with the real property and be binding upon all parties having any right, title
<br />or interest in any of the described lots, or any part thereof, their heirs, successors and assigns,
