� 5. CLOSING COSTS. The City shall pay all closing costs an�i eT�1a3oos <br /> connection with this transaction and the costs of including this transaction on the Grantors' abstracts <br /> pertaining to the remaining property. <br /> 6. DRAINAGE OF GRANTORS' RE1��IAINING PROPERTY. In order to <br /> accommodate drainage from the adjacent real estate which is owned by the Grantors,the City will <br /> provide concrete letdown structures into the drainway to be constructed on the tract of real estate <br /> described on Exhibit A. The City shall ascertain the appropriate location for the letdown structures <br /> by field survey during the construction of the drainway. <br /> 7. COMMITMENTS REGARDING REUSE PITS. The City will fill the Grantors' <br /> existing irrigation reuse pit which is located on the tract of real estate described on Exhibit A and <br /> will restore the land to grade in connection with the construction of the drainway. The parties agree <br /> and understand that replacement of the reuse pit is not necessary at this time, but that in the event <br /> �onstruction and use of a reuse pit becomes reasonable and prudent due to downstream.drainage <br /> concems,the City agrees to construct a replacement reuse pit of appro�cimately the same dimensions <br /> and volume as the existing pit at no cost to the Grantors. The Grantors will provide a location for <br /> construction and placement of the replacement reuse pit at no cost to the City. In order to <br /> accommodate the City's timing constraints for budgetary purposes, the parties agree that the City <br /> will have fifteen(15)months to plan and construct the replacement reuse pit after notification of the <br /> need for said pit by the Grantors and appropriate regulatory authorities including the Central Platte <br /> Natural Resources District. <br /> 8. PAYMENT IN LIEU OF CROSSING. In lieu of the City installing a culvert <br /> crossing over the drainway connecting the Grantors' remaining real estate which will be separated <br /> by the tract being purchased herein, the Grantors agree to accept a lump sum payment of Four <br /> Thousand Dollars ($4,000.00)and waive their rights to require a connection. <br /> 9. SERVICE ROAD ACCESS. The City shall install a pipe stock type gate to limit <br /> access to the service road for the drainway in order to preclude unauthorized motor vehicle access <br /> to the service road at 13th Street and neaz the northem boundary of the Shoemaker School property. <br /> The City will post and maintain signs at the service road entrances prohibiting use by motor <br /> vehicles. This prohibition shall not apply to authorized service vehicles. The City shall enforce said <br /> prohibition to the extent practical. <br /> 10. GRANTORS' PIVOT IRRIGATION SYSTEM. The parties agree that the pivot <br /> irrigation system currently serving the remaining east tract of the Grantors' property does not <br /> interfere unduly with the proposed drainway except that a portion of the last section of the pivot <br /> irrigation system will be allowed to pass over the above described real estate; however, if <br /> interference should later be found to adversely affect the tract of real estate described on E�chibit A, <br /> the City agrees to pay for such alterations to the pivot irrigation system as is necessary to eliminate <br /> such interference. <br /> 2 , <br />
