- � 98- it�2996 <br /> approved by the Regional Planning Commission and the City Council to be acknowledged by such <br /> owners, certified as to accuracy of survey by a registered land surveyor,and to contain a dedication <br /> of the easements to the use and benefit of public utilities, and of the street to the use of the public <br /> forever. In consideration of the acceptance of the plat of said HEAVENLY HAVEN SECOND <br /> SUBDIVISION,the Subdividers hereby consent and agree with the City of Grand Island,Nebraska, <br /> that they will install or provide at their expense the following improvements: <br /> 1. Paving. The Subdividers agree to waive the right to object to the creation of <br /> any paving or repaving district for Blaine Street where it abuts the subdivision. <br /> 2. Physical Access. The Subdividers verify that physical access to the lots in <br /> the subdivision is available by virtue of a Corrective Warranty Deed recorded with the Hall County <br /> Register of Deeds as Document 87-104099, which conveys the right of ingress and egress to said <br /> properties over and across Lot One (1), Meadowlark Estates Second Subdivision. <br /> 3. Water. Public water supply is available to the subdivision where the lots <br /> abut Blaine Street. However, individual water well systems shall be permissible on an initial basis. <br /> The Subdividers waive the right to protest the creation of any future water district within or abutting <br /> the subdivision. When a water district is formed to serve Meadowlazk Estates�Subdivision and <br /> Meadowlark Estates Second Subdivision,the three lots in Heavenly Haven Second Subdivision will <br /> be included and shall pay the appropriate assessments of that district. Any easements shall be kept <br /> free of obstructions and the Subdividers shall indemnify the City for any removal or repair costs <br /> caused by any obstructions. All lots abutting the street or public right-of-way located along the <br /> south side of the subdivision shall be connected to any public water supply constructed within said <br /> street or public right-of-way within two (2)years of district completion. <br /> 2 ° <br />
