<br />a single ma.n, as Trustor, executed that certain Nebraska Deed of Trust and Security Agreement (with
<br />Trustor's Disclaimer and Acknowledgement atta.ched thereto) ("Deed of Trust") dated May 19, 1994, in
<br />favor of JAMES I. SHAMBERG, as Trustee, for the benefit of THE EQUITABLE LIFE
<br />ASSURANCE SOCIETY OF THE iJ1vITED STATES, a New York corporation, which was recorded
<br />with the Clerk of Ha11 County, Nebraska, as Document No. 94-104207.
<br />WHEREAS, a11 of the indebtedness secured by the Deed of Trust has been paid.
<br />NOW, TI-�REFORE, AXA EQLTITABLE LIFE IN5URANCE COMPANY, a New York corporation,
<br />(f/k/a TI� EQUITABLE LIFE ASSURANCE SOCIETY OF TI-� iJNITED STATES) does hereby
<br />substitute itself as Trustee, in lieu of the above-named Trustee under said Deed of Trust, and does hereby
<br />grant, remise, release and reconvey unto the person or persons legally entitled thereto, but without
<br />representation, recourse or warranty, a11 the estate, title and interest derived to said Trustee by or through
<br />said Deed of Trust in the following-described real estate to wit:

<br />EXCEPT tract as described in the Return of Appraisers by the State of Nebraska, Department of Roads, as
<br />recorded April 10, 1961, in Book 9 at Page 97 of the Miscellaneous Records of Hall County, Nebraska; and
<br />also EXCEPTIlVG a tract of land of varied width, upon and through the S�/z SW 1 /a of said Sec6on 32,
<br />formerly known as the right-of-way of the St. Joseph and Grand Island Railway.
