<br />21. HazardousSu6stances.As vsed in this Section ZI: (a) "Hazardous Substances" are.those substances
<br />defined as toxic or hazardous substances, polIutants, ar wastes by Environmental Law and the following
<br />substances: gasoline, kerosene, other flammable or toxic petroleum products, toxic pesti.cides and herbicides,
<br />vola.tile solvents, materials contain.ing asbestos or fonmaldehyde, and radioactive mateiials; (b)
<br />"Erzvironmental Law" means federal laws and laws of the jurisdiction where the Property is located that
<br />relate to health, sa.fety or en.vironmental protection; (c) "Envzrorcmental Cleanup" includcs suy response
<br />actioq remedial acrion, or removal action, as defined in Environmental Law; and {d) an "Erzviroazmmental
<br />Condition" means a condition that can cause, contdbute to, or othenvise trigger an Environmental Cleanup.
<br />Borrower shall not cause or pe�it the presence, use, disposal, storage, or release of any Hazardous
<br />Substances, or tl�reaten to relea.se any Hazardous Substances, on or, in the Property. Borrower shall not do,
<br />nor aIIow an.yone else to do, anyth� affecting the Properiy (a) that is in violation of any Environmental
<br />Law, (b) which creates an Environmental Condition, or (c) which, due to the presence, use, or release of a
<br />Hazardous Substance, creates a condition that adversely affects the value of the Properiy_ The preceding two
<br />sentences shall not apply to the presence, use, or storage on the Property of small quantifies of Haaardous
<br />Substances that are generally rec a�nized to be appropriate to nortnal residential uses and to ma.intenance of
<br />the Property (including, but not limited to, hazardous substances in consumer prodncts).
<br />Borro�ver shall promptly give Lender written notice of (a) azry investigation, claim, demand, la.wsuit ar other
<br />action by any governmental or reaulatory agency or private party involving the Property and any Hazardous
<br />Substance or Environmental Law of �vhich Borrower has actual knowledge, (b) any Environmental
<br />Condition, including but not limited to, any spilling, leaking, discharge, release or tUreat of release of any
<br />I3azardons Snbstance, and (c) any condition caused by the presence, use or release of a Hazardous Substance
<br />which adversely affects the value of the Property. if Bosower learns, or is notified by any governmental or
<br />regalatory anthority, or any private pariy, that any removal or other remediation of any Hazardous Substance
<br />affecting the Properiy is necessary, Boaower shall promptly take all necessary remedial actions in
<br />accordance with Environmental Law. Nothing herein shall create any obliga.tion on Lendez far an
<br />Environmen.tal Cleanup.
<br />Non-UnifortnCovenants.Borrower and Lender covenant and agree as follows:
<br />22. Acceleratiort; Remedles,Lender shall give notice to Borrower prior to acceleration following
<br />Borrower's breacl� of any covenant or agreement in this Security Tnctrument (but not prior to
<br />accelerul3on �der Section 18 nnless Applicable Law provides otherwise). The notice shall specify: (a)
<br />the defanit; (b) the action required to cnre t&�e defanit; (c) a date, not Iess than 30 days from the date
<br />the notice is a ven to Borrower, by which the defualt must be cured; and (d) that failure tn cure the
<br />default on or before tlae date specifieti in the notice may result in acceleration of the sums secured by
<br />this Secrzrity Instrnment and sale of the Prog�erty. The aotice shalI further i�orm Borrower of tha
<br />right to reinstate after acceleration and the a�ight to bring a conrt action to acsert the non-existence of a
<br />default or any other defense of Borrower to acceleration and saie. If fhe defanit is not cured on or
<br />before the date specified in the notice, Lender at its ophon may require immediate payment fn full of
<br />all snms secared bq this Secnrity Instrumen� without further demand ancl may invoke the power of sale
<br />and any other remedies permitted by Applicable Law. Lender shall be entitled to collect stl expenses
<br />incurred in pnrsuing the remedies provided in this Section 22, inclnding, bnt not Iimited to, reasonable
<br />attorneys' fees and costs of tit[e evidence.
