<br /> Whereas, on the 8th day of .Tanuary� 1916, Riohard Seannell, then Biahop of Omaha, departed
<br /> this life, lea�ing a las�t will and testament� by which, after making cert�in cash legacie$, it was

<br /> - "I hereby give, d�vise and bequeath all the rest, residue and remainder of my
<br /> property, real and personal, of every name and nature, wherever situate, and whether held by me in
<br /> my individual cmpacity or fn my offici�.l capacity as such bishop, to John Henry Tihen, Bishop of
<br /> �Zincoln, Nebraska, and Patrick A. McGovern, Bishop of Cheyenne� �yoming, or the survivor of them�
<br /> 'upon the terms, conditions and trusts follo�ing, that is to aay: - to apply the sa.me and all part
<br /> ;,and parcels thereof� to and for the several uses and purpoaes for which the s�.me respectively ahs,l
<br /> at my death be held by me, and to convey the sa,me to m,y sucaessor as Biahop of Oma,ha when such

<br /> And �rhereas, on the 14th day of February, 1916, the s�,id 7rast Will and Testaxnent was duly
<br /> �;;proved, approved, probated and allowed, and recorded by the County Coi�rt of Douglas County� Neb-

<br /> ra�k�, �nd on said date 7�etters Testamentary were issued to the said John Henry Tihen and Patrick
<br /> A. �►IcGovern, �
<br /> And V9hereas, on the 20th day of July� 1916, party of the second part �ras duly appointed and
<br /> qualified as the succe�asor of said Richard Seannell� Bishop of Omaha, as to the Counties of Hall,
<br /> Greeley, How�,rd �.nd Wheel�r in the state of Nsbraska, with the titl� of Bishop of �earney, and on
<br /> ;said da.te entered upon- the duties of such office and is now in the occupation of the same;
<br /> IJow� Therefqre� Iri consideration of the premises and of the sum of One Dollar in hand paid by
<br /> the said party of the secoad part to the parties of the first part, the receipt whereof is hereby
<br /> ;acknowl�dged, and in accordance with the above provision of said I,ast Will and Testament, the s aid
<br /> �arties of th� first part do hereby bargain, grant� s�ll and convey unto the said party of the
<br /> second part� his heir$, successors and assigns, the following described real eetate eituate in the �
<br /> 'County of Hall and State of Nebraska, to-wit:

<br /> "CM in �'irst Addition to Wood River, as said lots are laid do�vn and described on the plat
<br /> of s�.id Tovm, recozded in ths office of the Register of Deeds of said County.
