<br /> probate i the county court of Douglas Cour.ty, Nebraska, ar.d the said John 7�.Hi11, Jr., as such
<br /> trustee�e tered into nossession of �aid prer�ises under said �vill and under the decree of the eaid

<br /> �PHEREAS, the said Lew 3�.Hi11 left surviving him as his heirs at law, tvro brothers, James
<br /> H.Hill and John �P.Fiill Sr., ana three children o� a deceased sister, to-wit: E�izabeth Sholl,
<br /> �eorge T.�Pil�on and Shirl.ey H.�filson, and,
<br /> �PAEREAS, thereafter� to-wit : on the llth day of November� 1909, an action was commenced in
<br /> � ths District Court of Douglas County, Nebraska by the said James H.HilI as plaintiff, again�st
<br /> the said John �.HiI� Jr., as truatee aQ aforesaid and �oining as defendantg all of the heirs .
<br /> at lavv of Lew �P.Hill� deceased� and others, in :�vhich action the construction of the said will and
<br /> the validity of said trust wae called into question and thereafter the said cause clul�' proceeded �

<br /> I to a decree on the 12th day of �ctober 1910 by which decree the trust abone described was termin-
