Peterson, the undersigned, being of legal age and ha.ving been first duly <br />sworn upon his oath deposes and states as follows: <br />1. The undersigned Affiant is the successor in interest in and to the real estate legally <br />described as one-half interest of Lot Four (4), Block Twenty-Two (22), Russel Wheeler's Addition <br />to the City of Grand Island, Ha11 County, Nebraska, Ai�ant being owner of the other one-half <br />interest. <br />2. That more than tluriy (30) days have elapsed since the dea.th of the decedent, <br />Maxine M. Peterson, who died December 28, 2003, as shown on the certified copy of her death <br />certificate attached hereto, and identified as Exhibit "A". <br />3. That said decedent and Affiant, being husband and wife, were the owners of the <br />above-described real property as tenants in common, each owning an undivided one-half. <br />4. 1'hat the above-named deceased who died December 28, 2003, left a Last Will and <br />Testament, da.ted June 5, 1964, by the terms of which a11 of her property, real and personal, was <br />devised to Af�ant. <br />5. That the value of the decedent's interest in the above-described real property did not <br />exceed the sum of $30,000.00 as determined from the value of her interest as shown on the <br />assessment roles of the Hall County Assessor's office for the year 2003, the year in which decedent <br />died. T'he Ha11 County Assessor's roles for the year 2003 indicated a total value of the above- <br />described property to be' $44,837.00 and the decedent's one-half interest in said properiy was <br />$22,419.00, less than the sum of $30,000.00. <br />6. That Ai�ant has contracted to sell the above-described property for the sum and it is <br />necessary to transfer the decedent's interest in such property to A�ant. <br />7. T'hat Affiant has signed a Contract of Sa1e for the entire above-described real <br />properiy for the sum of $38,000.00 and decedent's interest therein being the sum of $19,000.00 and <br />far less than the exemption sum of $30,0000 as now provided by Neb. Rev. Stat. §30-24,129. <br />8. No application or petition for appointment of a personal representative under the <br />
