<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> That I, John Helzer, Jr. , of Grand Island, Nebraska, executor of
<br /> the last will and testament of Anna Maria Helzer, deceased, also known as
<br /> Mary Helzer, pursuant to the power conferred upon me as such executor
<br /> by said will to sell the real estate of which she, the said Anna Maria Hel-
<br /> zer, was seized at the time of her death, in consideration of the sum of
<br /> $7, 63C. 0� to me in hand paid, the receipt of which is hereby acknowledged,
<br /> do hereby grant, bargain, sell and convey unto John F. Ruge and Martha
<br /> E. Ruge, husband and wife, of Chapman, Nebraska, as JOINT TENANTS,
<br /> and not as tenants in common, Lot 10 of Jones Addition to the City of Grand
<br /> Island, Hall County, Nebraska, together with all the tenements, heredita-
<br /> ments and appurtenances thereunto belonging, or in any wise appertaining.
<br /> IT BEING THE INTENTION OF ALL PARTIES HERETO, THAT IN THE
<br /> EVENT OF THE DEATH OF EITHER OF SAID GRANTEES, TH� ENTIRE FEE
<br /> SIMPLE TITLE TO THE REAL ESTATE DESCRIBED HEREIN SHALL VEST IN
<br /> THE SURVIVING GRANTEE,
<br /> TO HAVE AND TO HOLD the above described premises, with the appur-
<br /> tenances, unto the said grantees as JOINT TENANTS, and not as tenants in
<br /> common, and to their assigns or to the heirs and assigns of the survivor of
<br /> them, forever, and I do hereby, in my capacity as such executor and pursuant
<br /> to the power conferred upon me by said will, covenant with the grantees named
<br /> herein and with their assigns and with the heirs and assigns of the s��rvivor of
<br /> them that I am, by virtue of the power aforesaid, lawfully seized of said pre-
<br /> mises as such executor; that said premises are free from all encumbrances
<br /> and that I, in my capacity as such executor, have lawful authority to sell the
<br /> same, and I do hereby, in my official capacity as such executor of said w•ill,
<br /> covenant and agree to warrant and defend said premises unto the grantees
<br /> named herein and unto their assigns and unto the heirs and assigns of the sur-
<br /> vivor of them, forever, against the lawful claims of all persons whomsoever.
