<br /> upon them under the said Will and in consideration of the aum of SEVEN HUNDRED
<br /> FIFTY DOLIARS ($750.00) to me psid by the partq of the second part, the receipt
<br /> xhereof is hereby conE'essed and acknoWledged, do by these presents grant, bargain, .
<br /> sel]., read8e, release, comrey and confirm unto the said party of the second part
<br /> and to his heirs and assigns forever all of the followi.ng described tract of real
<br /> estate situated, lying and being in the County of Hall, State of Nebraska, twr�it;
<br /> The westerly one-fourth of the southerly one-half (W�62) of
<br /> `a``� Block Eleven (11) in Windolphts Addition to the City of Grand
<br /> Island, Nebraska, according to the recorded plat thereof;
<br /> Together vith all and singular the tenements, hereditaments and appurtenances
<br /> thereunto belonging or in a�y wi.se appertaining; and also all the rights, estate,
<br /> title� interest, property, possession, claim and demand whatsoever which the said
<br /> Fred B. Winter had in his lifetime and at the time of his decease and r�rhich the
<br /> said parties of the fixst part ha.ve by virtue of the saa.d Last Will and Testament,
<br /> or otherwise, of� in or to the above granted premises and every part and parcel
<br /> thereof wi.th the apparteaences. To have and to hold the said premises, being the
<br /> real estate hereinbefore described with the hereditaments and appurtenancea thereto
<br /> belonging, unto the said party of the second part, hia heirs and assigns forever.
<br /> And the said parties of the first part, the said Richard E. Stephens for himself,
<br /> his heirs� executors and ac�rainistrators� and the said The First National Bank of
<br /> Grand Island, for itself and its successors, do each severally, and not jointly nor
<br /> the one for the other, nor for the act or deed of the other, but each for his and
<br /> its own acts only, covenants, promises and agrees to and with the said party of the
<br /> second part that he and it, respectively, each is lawfully the Trustee of and under
<br /> the said Last Will and Testament of the said Fred B. Winter, Deceased, that he and
<br /> it each is lawf'ul.lp seized of said premises; that said premises are free froca encum-
<br /> brance and that he and it have power to convey as aforesaid, and each has in all
<br /> respects acted in mal�.ng this conveyance in pursuance of the authority granted in
<br /> and bp the said I,ast Will and Testament of said Fred B. Winter, Deceased, and that
<br /> he and it respeetively each has not made, done or suffered ar�y act, matter oi� thing�
<br /> whatsoever, since he and it each xas Trustee as aforesaid whereby the above granted
<br /> premises, or am� part thereof, are, shall or may be impeached, charged or encumbered
<br /> in any manner whatsoever.
