<br /> � Whereas, in an action of partition pending in the District
<br /> Court of Hall Countp, �here Augusta Friesm� a►nd William Friesman were
<br /> plaintiffs �'►d Jacob Brandt and Lena Brandt, his wife; James Donigan and
<br /> Ella Louise Donigan, his wife; Mary Billesbach and Fred Billesbach, her
<br /> husband; Winifred Vierk and Glen Vierk, her husband; Anthony Donigan,
<br /> gingle; Kenneth Donigan and Margie Donigan, hig wife; Vincent Donigan,
<br /> �ingle; Walter A. Brandt, single; Alma A. Brandt, single; Henry J. Brandt,
<br /> Jr., single; Margaretha MaCullough and David McCullough, her husband;
<br /> David R. Brandt and Wilma Brandt, his wife; John C. Brandt and Pliyllis
<br /> Brandt, his wife; Herman Brandt, single; Lester B. Brar.dt and Blanche �
<br /> Brandt, his Wife; August Kroeger and Frieda Kroeger, his wife; Dora Schultz
<br /> and Gtto schultz, her husband; Bertha Peters and August Peters, her
<br /> husband; Alma Weller and Calvin Weller, her husband; Martha Krohl�owski and
<br /> Gilbert Krolikowski, her husband; Helen Baasch and Fred Baasch, her
<br /> husband; Dortha Hall and John Hall, her husband; Rose Goehring and Clements
<br /> Goehring, her husband; Clarence R. Brandt and Marion Brandt, his wife;
<br /> Augusta Friesman, administratrix of the estate of Margaretha Kracht,
<br /> deceaged; and Leonard Boguslaw, are defendants, for the partition of the
<br /> premises hereinafter described, the undersigned Referee, appointed by
<br /> said court to make partition of said real estate, made report in wri�ing,
<br /> dulp signed, setting forth that partition of 4aid land could not be
<br /> made without great prejudice to the oWners thereof, which report wag
<br /> duly examined by s$id court, and said court being satisfied therewith,
<br /> confirm the s�e, and thereupon made an order and caused the s�e to be
<br /> entered, directing me, as said Referee, to sell said premises on the
<br /> following terms, to-wit: that the Referee proceed to sell said premises
<br /> at public sale ag upon execution at the north front door of the Court
<br /> House, in the City of Grand Island, hall County, Nebraska, the termQ of
<br /> sale being fifteen per cent (15�) cash and the balance upon confirmation.
<br /> And in pursuance of said order I caused a notice to be
<br /> published in the Grand Island Daily Independent, a newspaper printed
<br /> and in general circulation in Hall County, that I would offer said lands
<br /> for sale at the north front door of the Court House in said county on
<br /> the 2nd day of December, 1955 at 2:00 P. M. of said day and at the
<br /> time and place stated in said notice and after said notiee had been
<br /> published for more than thirty days, I offered said land, to-wit:
<br /> Lot Two (2), Block gixteen (16), in H. G. Clarkts Addition
<br /> to the City of Grand Island, Hall County, Nebraska,
<br /> for sale at public auction and gold the s�e to John E. BaudendiQtel and
<br /> Helen A. Baudendistel, husband and wife, as joint tenants and not as
<br /> tenants in common, for the swn of Three Thougand Four Hundred Fifty & I�o�100
<br /> Dollars (�3,450.00), they being the highest bidders therefor. And
<br /> afterwards, on the 16th day of December, 1955, said court approved and
<br /> confirmed said sale and by an order directed me, ag said Referee, to
<br /> execute to said purcha9ers as joint tenants with full right of survivorship
<br /> a deed conveying said land to them in fee simple.
<br /> \rOW, THEREFORE, I, Harry Grimminger, Referee, in conQideration
<br /> of the premises and the s�► of Tbree Thousand Four Hundred Fifty & No�100
<br /> Dollars (�3,450.00) so bid and paid by the said John E. Baudendistel and
<br /> Helen A. Baudendistel, and by virtue of the powers veQted in me by law,
<br /> do by these presents, grant, sell and convey unto the said John E.
<br /> Baudendi,ytel and Aelen A. Baudendistel, as joint tenants and not as
<br /> tenants in common, and to their assigns, or to the heirs and assigng of
<br /> the survivor of them, the real estate described as follows:
