<br /> THIS INDENTURE, Made this ��—'" day o� , 195��
<br /> between VVm. P. Mullen, executor of the Last Will and Testament of
<br /> Perian KreidEr, late oP Hall County, Nebraska, deceased, party of the
<br /> f ir st part, and Delbert Barrows and Eleanor Barrows, husband and wife,
<br /> of Hansen, Nebraska, as tenants in common, parties of the second part.
<br /> WHEREAS, by his Last Will, dated September 11, 1954, the
<br /> said Perian Kreider appointed thE said 4Ym. P. �lfullen, party of the
<br /> first part, as executor thereof; and
<br /> ��5, th� said Testator died on the 14th day of September, �
<br /> 1954, and his said Will was, on the 18th day oP October, 1954, duly
<br /> approved and allowed by the Probate Court of the said County of Hall,
<br /> State of Nebraska, and said executor was duly appointed as said
<br /> executor and he duly �ualified as such by putting up a Twenty-f ive
<br /> Thousand Dollar (�25,000.00) surety bond for the faithful performance
<br /> of his duties as such executor, and said bond has been duly approved �
<br /> by the County Judg�e of Hall County, Nebraska.
<br /> WHERF�ti.S, under and by virtue of the terms and conditions of
<br /> the Last V1i11 and Testament of the said Perian Kreider, deceased, �
<br /> the said executor was authorized and d ir ected within one (1) year -
<br /> of the date of the death of the said Testator, to sell the real
<br /> estate hereinafter described, and to make a �ood and sufficient deed
<br /> of conveyance; and ��►Y?ereas the said executor, being the first par ty,
<br /> did, on the 9th day o�' November, 1954, at Two Otclock p.m. of said
<br /> day, sell by public vendue, the real estate hereinaPter �escribed, to
<br /> Delbert Barrows and Eleanor Barrows, husband and wif e, as tenants in
<br /> common, of HansEn, Nebraska, for the sum of Sixteen Thousand, Four
<br /> Hundred Eighty Dollars (�16,4�0.00) , '�they being the highest bidders
<br /> therefor; that after said sale, a report of same was filed with the
<br />� Hon. Charles Bossert, County Judge of Hall County, Nebraska, and that
<br /> . , on the /9�• day of November, 1954, the said County Judkme o� Hall
<br /> County, Nebraska, entered an Order approving said sale and authorizing
<br /> said executor to execute an Executor�s Deed to the pur chaser upon the
<br /> I�; payment of the balance oY the pur chase price.

<br /> Now, this indenture, witnesseth: That in the exercise of the
<br /> powers to T�Tm. P. P�'fullen, given bp the said tiVill and every other power
<br /> him thereunto enabling, and in consideration o� the su.m of Sixteen
<br /> Thousand, Four Hundred r�ighty Dollars (�16,4g0.00) to him in hand
<br /> paid by the said party o� the seco nd part, the receipt of which is
<br /> hereby acknowledged by the said party of the first part, executor,
<br /> as aforesaid, doES hereby grant, bargain, sell, and convey unto the
<br /> said Delhert Barrows and Eleanor Barrows, husband and wife, as tenants
<br /> in common
<br /> The West Half of the Northwest �`uarter (W2NW4) of
<br /> Section Thirty-three ( 33�, Township Nine (9) Vorth,
<br /> � Range idine (9) �iest of the 6th P.ai. in Hall County, Nebraska
<br /> together with all the tenements, hereditaments and appurtenances to
<br /> the same belongin�, and all of the Estate, Right, Title, Interest,
<br /> Claim or Demand whatsoever of thE said Perian Kreider, of, in, or
<br /> to the same or any part thereof.
<br /> TO H,�VE ti�TD TO HOLD the above described real estate, with
<br /> the appurtenances, unto the said Delbert Barrows and Eleanor Barrows,
<br /> husband and wiYe, as tenants in common, and to their heirs and
<br /> assigns forever, and I, the said 4Ym. P. Mullen, as executor of the
<br /> Last �tdill a�d Testament of Perian Kreider, hereby covenants with the
<br /> said Delbert Barrows and Eleanor Barrows, husband and wiYe, as tenants
<br /> in common, that as executor, I hold said premises taith good and
