<br /> WITNESSETH that the said parties of the f irst part being the duly appointed, .
<br /> qualified and acting Executors of the said Fred B. Winter, deceased, under his I,ast
<br /> Will and Testament, which is of record in the County Court of Hall County, Idebraska,
<br /> having been unable to sell the real estate hereinafter described within one year
<br /> from the date of the death of said Fred B. Winter, deceased, as directed in said
<br /> L'ast Will and Testament, .by virtue of the power and authority granted and conferred -
<br /> upon them under the said Will and for the purposes of carrying out the intent of
<br /> said '�Jill, .do by these presents grant, bargain, sell, remise, release, alien, con-
<br /> vey and conf irm unto the said parties of the second part and to their successors
<br /> and assigns forever all of the following described tracts, pieces and parcels of
<br /> land situate, lying and being in the County of Hall and State of Nebraska, to-wit:
<br /> All of the westerly one'-half of the southerly one-half (W2S2) (or what
<br /> would be Lots Five (5) and Six (6) ) of Block Eleven �ll) in Windolph's -
<br /> Addition to the City of Grand Island, Hall County, Nebraska, according
<br /> to the recorded plat thereof;
<br /> Together with all and singular the tenements, hereditaments and appurtenances there-
<br /> unto belonging or in anywise appertaining and also all of the estate, right, title,
<br /> interest, property, possession, claim and demand whatsoever, which said f irst par-
<br /> ties have under �nd by virtue of said Last Will and Testament, or otherwise, of,
<br /> in and to all of the above granted premises� and every part and parcel thereof with
<br /> the appt�rtenances;
<br /> TO HAVE AND TU HOLD the above described premises with the appurtenances unto
<br /> ttie said second parties and ta their successors and assigns forever; and the said
<br /> parties of tne first part; the said The First National Bank of Grand Island, for
<br /> itself and its successors, and the said Richard E. Stephens, for himself� his heirs,
<br /> executors and administrators, do each severally� and not jointly nor the one for
<br /> the o ther� nor for the act or deed of the other� but each far its and his own acts
<br /> only, covenants, promises and agrees to and with the saic� parties of the second part
<br /> that it and he, respectively, each is lawfully the �xecutor of and under the Last
<br /> Will and Testament of the said Fred B. Winter, deceased; that it and he each is
<br /> lawfully seized of said premises; that said premises are free from encumbrance and �
<br /> that it and he have power to convey as aforesaid� and each has in all respects acted
<br /> in making this comreyance, in pursuance of the authority granted in and by the said
<br /> Last Will and Testament of said rred B. Winter, deceased� and that it and he res-
<br /> pectively each has not made, done or suffered any act, matter or thing whatsoever,
