DEED OF EXECUTOR UNDER PO�VER IN WILL
<br /> THIS DEED, made this 21st da.y of October, 195�1�, by and
<br /> � between Bayard H. Paine, Jr. , of the City oP �rand Island, County
<br /> of Hall, and State� of Nebraska, as executor of the Last Will and
<br /> Testament of Carrie L. Fraser, deceased, late oP the City of Grand
<br /> Island, County of Ha11, and the State o� Nebraaka, party of tne
<br /> first part, and rbsalio Briseno and I�aria A. Briseno, husband and
<br /> wife, as JOINT TENANTS, and not as tenants in common, of the City ,�
<br /> of Grand Island, County of Hall, and State of Nebraska, parties of
<br /> the second part;
<br /> Si2TNESSETH, that the said Aarty of the first Aart, the duly
<br /> apnointed, aualified and acting executor of the estate of the said
<br /> Carrie L. Fraser, deceased, under h�;r Last Will and Testament, which
<br /> is of record in the oPfice of the Probate Court of Ha11 County,
<br /> Nebraska, by virtue of the power and authority granted and conferred
<br /> upon him, under the said will, and by virtue of the further power,
<br /> authority, apnroval and order of the County Court of HalZ County,
<br /> Nearaska, under date of June 14, 1954, and in consideration of the ,
<br /> sum of SIX THOUSAND and A10/100 (�6,000.00) DOLLARS, to him paid by �
<br /> the parties of the second �art, the recei�t whereof is hereby ack-
<br /> nowledged, does by these presents grant, oargain, sell, remise, re-
<br /> ].ease, convey and confirm unto the said parties of the second part,
<br /> ancl to their heirs and assigns forever, a11 of the following descri�red
<br /> real estate, situated in the City of Grand Island, County of HaZl,
<br /> and State of Nebraska, to-wit;
<br /> Lot Seven (7) , in Fractional Block One
<br /> Hundred Eighteen (118) , in Railroad
<br /> Addition to the City of Grand Island,
<br /> Hall County, Nebraska;
<br /> together with a11 the tenements, hereditaments and appurtenances
<br /> thereto nelonging or in anywise appertaining; and also a11 the es-✓
<br /> tate, right, title, interest, proberty, nossesaion, claim and demand
<br /> whatsoever, which the said testatrix had in her Iifetime, and at the
<br /> time of her decease, and which the said party of the first nart has,
<br /> by virtue of the said Last S9i1Z and Testament, or otherwise, of, in,
<br /> or to the above granted premises, and every �art and parcel thereof,
<br /> with the appurtenances.
<br /> IT BEING THE INTEi1TTI0N OF ALL pARTI�'S HEFLETO, THAT IN THE
<br /> EVENT OF THE DEATH OF EITHER OF SAID GR�TTEES, THE ENTIRF FEE SII�PLE

<br /> TO HAVE AND Tp HOLD the said above described premises, with
<br /> the hereditaments and apnurtenances thereof, unto the said narties
<br /> of the second part, their heirs �.nd assigns, Porever.
<br /> And the said narty of the first part, for him�elf, his
<br /> heirs, executors and administrators, cloes covena.nt, promise a.nd un-
<br /> dertake to and with the said parties of the second p�rt, their heirs
<br /> and assi�ns, that he is lawfully the executor of the Last �ill and
<br /> Testarnent of the said Carrie L, Fraser, deceased, , and has power to
<br /> convey as aforesaid, and has the additional bower by approval of the ✓
<br /> County Court of Ha11 County, Nebraska, as afores�.id, and has in a11
<br /> respects acted, in making this conveyance, in pursuance oP the au-
