Licensee hereby waives any claim for damages against Licensor, its officers, employees, agents and independent contractors for any damage or injury that may result to the Garage. Licensee shall indemnify and hold Licensor harmless from and against all claims arising out of the use or occupancy of the Garage. 3. In the event the Garage is destroyed or damaged to the extent the Garage cannot be safely used or is a danger to Licensor's employees, students, guests or invitees, within ninety (90) days a$er receipt of written notice from Licensor, Licensee shall either remove the Garage, repair or replace the Garage at Licensee's expense. If the Garage is removed, this License Agreement shall terminate and be of no further force or effect. 4. This License Agreement shall take effect upon the date it is executed by the parties hereto and shall continue on a perpetual basis or until such time as the Garage is removed as provided herein. 5. This License Agreement shall be binding upon the parties hereto, their successors and assigns and shall run with the land. In the event Licensee conveys Licensee's Property to a third party, Licensee shall have no further obligation herein. 6. This License Agreement shall be construed in accordance with the laws of the State of Nebraska. 7. This License Agreement constitutes the entire agreement between the parties, notwithstanding any other oral or written agreement to the contrary.
