2�11a� <br />paymerit of the Trustee's fees actually incurred, and pay second the obligations secured by <br />this Deed of Trust; and the balance, if any, shall be paid to the person or persons legally <br />ent�tled thereto. Any person, including the Beneficiary, may purchase said property at such <br />sale. <br />The Trustor covenants that at the time of delivery of these presents, he is seized of said <br />property in fee simple, and that said property is free of encumbrances, except <br />encumbrances, easements, rights-of-way, restrictions and reservations of record, and he will <br />properly maintain the property, keep all buildings insured for fire and extended coverage in <br />an amount equal to the unpaid balance of the aforesaid Note, with toss payable to the <br />Bene�ciary, and will pay att taxes and assessments against said property and amounts due <br />on prior encumbrances, and if he shatl fail to pay insurance premiums or taxes on amounts <br />due on prior encumbrances, the Beneficiary may pay the same, and oil amounts so poid <br />shalt become add�ional indebtedness due hereunder; and in case of foreclosure or other <br />proceedings to which the Trustor shall be a party. Trustor will pay any reasonable attomey <br />fees incurred by Beneficiary or Trustee in such foreclosure or other proceedings to the extent <br />permitFed by applicable law. <br />Should the Beneficiary hereunder be made a party to any action affecting this Deed of <br />Trust or the fitle to said property, the Trustor agrees that all court costs and a reasonable <br />aitomey fee paid by the Beneficiary shall become additional indebtedness due hereunder, <br />and the Trustor hereby releases and waives alt ctaims to said property as a homestead <br />exemption or other exemption now or hereafter provided by law. <br />It is agreed that in case of default in payment of said principa! or interest or a breach <br />of cny of the covenants herein, or upon any sale or transfer of the property by the Trustor, then <br />said principal sum hereby secured and interest thereon may, at the option of the Beneficiary, <br />become due and payable at once. Anything in said Note and this Deed of Trust to the <br />contrary nofwithstanding, upon default, the Beneficiary shall be entitled to immediate <br />possession of said property, together with the rents, issues, and profits therefrom, and on <br />failure of Trustor to deliver such possession, the Beneficiary shall be entitled to a receiver for <br />said property that may be appointed by any court of competent jurisdiction. <br />Ail the covenants herein shall be binding upon the respective hei�s, personal <br />representatives, successors, an assigns of the arties her to. <br />Executed on this day of ��2'� � � 2011. <br />f � <br />/�' � <br />LUKE A.
