MARSH being first duly sworn upon oath, deposes and states that: l. Willard D. Marsh created the Willard D. Marsh Revocable Living Trust Agreement dated March 5, 1993, as amended July 18, 1997, May 21, 1999 and May 14, 2003, the ("Trust Agreement") wherein he designated himself as the initial Trustee of the Trust, Rosella A. Marsh as the first successor Trustee and Ivan G. Marsh as the subsequent successor Trustee; 2. From the date of the creation of the Trust until Apri14, 2007, Willard D. Marsh served as Trustee of the Trust; 3. On Apri14, 2007 Willard D. Marsh executed a Resignation of Trusteeship resigning as Trustee due to advanced age, declining health and his desire not to continue with the responsibility for managing the trust property and by the execution of an Acceptance Rosella A. Marsh accepted the trusteeship of said Trust effective as of Apri14, 2007 and agreed to administer said Trust in accordance with the terms of said Trust Agreement and the laws of the State of Nebraska; 4. Willard D. Marsh died on April 14, 2007; 5. Pursuant to ARTICLE VIII, Paragraph B. of the Trust Agreement, the Willard D. Marsh Family Trust ("Family Trust") was created as a result of the death of Willard D. Marsh and Rosella A. Marsh continued to serve as Trustee of said Family Trust; 6. As of the date hereof Rosella A. Marsh has executed a Resignation of Trusteeship resigning as Trustee of the Family Trust due to advanced age, declining health and her desire not to continue with the responsibility for managing the trust property and by the execution of an Acceptance of Trusteeship Ivan G. Marsh has accepted the trusteeship of said Family Trust and has agreed to administer said Family Trust in accordance with the terms of said Trust Agreement and the laws of the State of Nebraska; 7. Affiant is currently serving as the successor Trustee of said Family Trust and the Family Trust grants Affiant as Trustee all powers under the Nebraska Uniform Trust Code; 8.
