Box 790 Grand Island, NE 68802-0790 Certificarion of Trust Recorder's Memo: Lot Three (3) and the Southerly 46.4 feet of Lot Two (2) in Block Four (4) in Lambert's Second Addition to the City of Grand Island, Hall County, Nebraska, and Lot Nine (9), Bernhard Voss First Subdivision, Hall County, Nebraska, as surveyed, platted and recorded CERTIFICATION OF TRUST IVAN G. MARSH being first duly sworn upon oath, deposes and states that: 1. Rosella A. Marsh created the Rosella A. Marsh Revocable Living Trust Agreement dated March 5, 1993, as amended July 18, 1997, May 21, 1999 and May 14, 2003, the ("Trust Agreement") wherein she designated herself as the initial Trustee of the Trust, Willard D. Marsh as the first successor Trustee and Ivan G. Marsh as the subsequent successor Trustee; 2. From the date of the creation of the Trust until the date hereof, Rosella A. Marsh has served as Trustee of the Trust; 3. Willard D. Marsh, the first successor Trustee of the Trust died on April 14, 2007; 4. As of the date hereof Rosella A. Marsh has executed a Resignation of Trusteeship resigning as Trustee due to advanced age, declining health and her desire not to continue with the responsibility for managing the trust property and by the execution of an Acceptance of Trusteeship Ivan G. Marsh has accepted the trusteeship of said Trust and has agreed to administer said Trust in accordance with the terms of said Trust Agreement and the laws of the State of Nebra.ska; 5. Affiant is currently serving as the successor Trustee of said Trust and the Trust grants Affiant as Trustee all powers under the Nebraska Uniform Trust Code; 6. The Trust is a grantor trust and may be revoked by grantor, Rosella A. Marsh; 7. The Trust is in full force and effect and as of the date hereof Affiant is serving as Trustee of the Trust; and 8. Rosella A. Marsh is the sole beneficiary of the Trust during her lifetime and Ivan G. Marsh, Lynda R. McComb and Eldon D. Marsh are the remainder beneficiaries of the Trust, and 9. The Trust has not been revoked or amended to make any representation contained in this Certification of Trust incorrect and the signature of Affiant is as the Trustee of the Trust.
