Hazardaus Substances. As used in tlnis Section 2&: (a) "Hazardaus Subst.ances° are thase substances <br />defined as tolcic ar hazardous substances, pollurauits, `o� wastes by Envi�oum�enta.l %aw and the following substanc�: <br />gasoliwe, kerasene, otlaer flaxz�naable ar toxic petroleum proclucts, toxic gesCici�les and herbicides, volatile salvents, <br />materials contai�ung asbestas or formaldehyde, and radioactive materials; (b} "Env�ranmentaI L,aw" zxaeans federat <br />laws and laws of the jurisdiction where the ProperCy is lacated that relate eo bealth, safety or envurarunental pratection; <br />(c} "Environmenbl Cleamup" includes any response acrion, re�edial action, or remova� action, as defined in <br />Bnviconmental I.aw; and {d) an "Enviranmental Condition" means a condiaon that can cause, contribuCe to, ar <br />otherwise trigger an Erivironmantal Cleauup. <br />Borcawer shall not cause or permit the presence, use, c�isposal, storage, or release of a�y Hazardous 5ubstapces, <br />or tlxreaten to release any Hazardaus Substances, on or in the Property. �onower stiall nat do, nor alIow anyoae else <br />to do, anything affecting ihe Property {a) that is in vialation of any Envirann►antal Law, (6} which creates an <br />Enviranmental Condition, or (c) which, due to the presence, use, or release of a Hazardous Su6stance, creates a <br />condition that adversely affects the vatue of the Peoperty. The preceding two sentences shall not apply to the <br />presence, use, or storage on the Property of small quarbtities of Hazardous Substances that are generaUy recognizsd <br />to be appropriate ta normal residential uses �nd ta rnaintenance of the Properry (including, but nat limited ta, <br />hazardous substances in consumer products). <br />Barrower shall prompdy give Lender written notice of {a} any investigation, claim, demaad, lawsuit or otheg <br />action 6y any govemmental or regulatory agency or private party involving the Property and any Hazardou� Substac►ce <br />or Envu onmental Law of which Borrower has actual knowledge, (b) any Environmental Condition, including but not <br />Limited to, any spzlling, Ieaking, ctischarge, retease or threat of release af any Hazardous Substance, and (c} any <br />conditioia caused by the presence, use or release of a Hazardous Substance which adversely a€ffects the value of the <br />Praperty. If Borrawer learns, or is notified by any gov�r�mental or regulatory authority, or any private party, that <br />a�y �emoval or other rem�diation of any Hazardous Substance affecting the Properry is necessary, Borrower shal] <br />prompdy take al� necessary remediat actions in accordance with Environtnental Law.
