201108105 <br />(I� "Electronic Fands Transfer" means any transfer of funds, other than a ttansactian originated by check, <br />draft, ar sim�ilar paper iushument, which is initiated through an electronic terminal, telephonic inshument, <br />c�mputer, or magnetic tape so as to arder, instcuct, or authorize a financial institution to debit or credit an <br />account. Such term includes, but is not limited to, point-of-sale transfers, auto�ted teller maclune transactions, <br />transfers initiated by teleghone, wire transfe�s, and automaYed clearinghouse transfers. <br />(L) "Escrow Items" means those items that are d�cribed in Section 3. <br />(N� "Miscellaneous Procexda" means any compensation, settlement, award of damages, or proceeds paid by <br />any third pariy {other than inc,�rrsmce proceeds paid under the coverag�s described in Section 5) for. (i) daa�ge to, <br />or destruction of, the Property; (ii) condeinnation or ather taking af all or any part of the Properiy; <br />(iii) conveyaace ia lieu of conde�ation; or (iv) misrepresentations of, or omissions as to, the value andlor <br />condition of the Property. <br />(l� "Mortgage Insarance" means insurance grotecting Lender against the nonpay�nt of, or default on, the <br />Loan. <br />(0) KPeriodic Payment" means the regularly scheduled amaunt due far (i} principal and interest under the Note, <br />plus {ii) any amounts under Section 3 of tUis Security Ins�at. <br />(P) "RESPA" �ans the Real Estate Settlemeat Procedures Act (12 U.S.C. §2601 et se�.) aad its impleuienting <br />regulation, Regulation X(24 C_F.R Part 3500), as they might be amended from time to time, ar any additional ar <br />succe,ssor legislation or regulatian that governs the same snbject matter.
