Wiese; Jerry Lee Wiese, Co-Trustee of the Wiese Family Trust; and <br />Linda Carol Semm, Co-Trustee of the Wiese Family Trust, herein referred to as "GRANTORS" <br />and Jerry Lee Wiese, herein referred to as "GRANTEE". <br />WITNESS: That for and in consideration of one dollar and other valuable consideration <br />received by Grantors: Glen E. Wiese; Jerty Lee Wiese, Co-Trustee of the Wiese Family Trust; <br />and Linda Carol Semm, Co-Trustee of the Wiese Family Trust and Jerry Lee Wiese, Grantee, the <br />parties agree as follows: <br />1. That the Grantors do hereby grant and convey to Grantee, and Grantee's agent or <br />tenant, a permanent easement for the purpose of ingress and egress across lands owned by <br />Grantors, legally described as follows; <br />The Southwest (SW 1/4) Quarter of Section Twenty-Two (22), Township <br />Twelve (12) North, Range Ten (10) West of the 6` P.M., Hall County, Nebraska. <br />2. This easement is for the purpose of ingress and egress by Grantees, their <br />contractors, and a.ssigns to be used by Grantees to enter Grantors' property to conduct faiming <br />operations and to transport agricultural equipment and products to and from said properly, and <br />more particularly the use of those grain bins situated on that property, whether owned by the <br />Grantee or owned by others. <br />3. Grantors shall be responsible for any maintenance for the easement necessa,ry to <br />use the easement for its intended purpose, and Grantees shall not conduct any maintenance <br />activities without the prior approval of Grantors. <br />4. This Grant of Easement shall run with the land and shall be binding and shall <br />enure to the benefit of the parties to this agreement, their respective heirs, successors, or assigns. <br />5. It is agreed that this agreement shall be governed by, construed, and enforced in <br />accordance with the laws of the State of Nebraska. <br />6. This agreement shall constitute the entire agreement between the parties and any <br />prior understanding or representation of any lcind preceeding the date of this agreement shall not <br />be binding on either party except to the extent incorporated in this agreement. <br />7.
