<br /> Sta�e of Nebraska, Executor of the Last Will and Testament of Anna E. Schimmer, deceased, late of Grand Island, in the
<br /> County of Hall, State of Nebraska, pa rty of the f irst part, and Fred Hongsermeier and Louise Hongsermeier, his wife,
<br /> both of the Ccsunty of Hall, State of Nebraska, parties of the second part;
<br /> WITNESSETl1, that the party of the f irst part, the duly appointed, qualified and acting Executar of the said Anna
<br /> E. Schimmer, deceased, under her Last Will and Testament, which is of record in the off ice of the Probate Court of Hall
<br /> County, Nebraska, by virtue of the power and authority granted and confirmed upon him under said Will, and in consideratimn

<br /> grant, bargai.n, sell, remise, release, alien, convey and confirm unto said parties of the second part as Joint Tenants
<br /> and not as Tenants in Gommon, with survivorship between them, all of the following described tract, piece and parcel of

<br /> Tawnship Ten (10) North, Range Nine (9), West of the 6th P.M., including all of the land included in the Patent from the
<br /> United States to Anna E. Schimmer recorded in Book 1 of Patents at Page 406 in the office of the Register of Deeds of
<br /> Hall County, Nebraska, subject, howeier,� to the right-of-�ray over the South 20 feet of Lots 6 and 7 and the Southeast
<br /> t�uarter of the Southeast Quarter (SE;}SE4) of said Section Two (2) in favor of Hall County, Nebraska, recorded in Book
<br /> 43 at Page 153 of the Deed Records of Hall County, Nebraska, according to the recorded plat thereof, including the
<br /> granary and lean-to, and the windmill head now on the windmill on the above descr�bed premises, subject only to the
<br /> rights of the tenancy of Harry Schimmer as occupping tenant of said premises, whose tenancp expires Mar�h l, 1953, and
<br /> who is the awner of the f ollawing buildings and improvements on sa.id premises, to�it: Corn crib, calf shed, Propane
<br /> tank, two brooder houses, the fence and posts around the feed yard, which chatCel property is not included in this
<br /> conveyance;
<br /> together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in any wise
<br /> appertaining; and also all the estate, right, title, interest, property, possession, claim and demand whatsoever, which
<br /> the said Testatrix had in her lifetime, and at the time of her decease, and which the said party of the f irst part has
<br /> by virtue of the said Last Will and Testament, or otherwise, of, in or to the above granted premises and every part and
<br /> parcel thereof with the appurtenances; it being the intention of all parties hereto, that in the event of the death of
<br /> one of the said second parties, tke entire fee simple title to said real estate above described shall vest in the "
<br /> survivor of them;
<br /> TO HAVE AND TO HOLD the said premises, the tracts of land aforesaid, with the hereditaments and appurtenances
<br /> thereof, unto the said second parties and to the hei.rs and assigns of the survivor of them forever; and the said party
<br /> of the first part, for himself, his heirs, executors and administrators, does hereby. covenant, promise and undertake to and
<br /> with the said parties of the second part and their assigns ar to the survivor of them and the heirs and assigns of such
<br /> survivor, that he is lawfully the Executor of the La.st Will and Testament of the said Anna E. Schi�ner, and has pawer
<br /> to convey as aforesaid, and has in all respects acted, in making this conveyance, in pursuance of the authoritp granted
<br /> in and bp the said Last Will and Testament, and that he has not n�de, done or suffered any act, matter or thing whatso-
