<br /> State of Nebraska, F.xecutrix of the Last Will and Testament of Anna Kluge, deceased, late of Grand Island, in the
<br /> County of Hall, Sta.te of Nebraska, party of the f irst part, and Christian M. Knudsen and Ida K. Knudsen, his wife,
<br /> both of Grand Island, in the County of Hall, State of Nebraska, parties of the second part:
<br /> WITrESSETH, That the said party of the first part, the du7�y ��appointed, qualified and acting F.xecutrix of said
<br /> Anna Klu�e, deceassd, under her Last Will and Testament, which is of record in the office of the Probate Court of Hall

<br /> remise, release, alien, convey an d confi.rm unto said parties of the second part as Joint Tenants and not as tenants
<br /> in common, with survivorship between them, all of the following described tract, piece and �arcel of land situate, lying
<br /> and being in the County of Hall and State of Nebraska, te-ti�it:
<br /> The Ilortherly Si.xty (60) feet of I:ot Five (5) in Block Se��enty-five (75) of the Original T�an, now City, of
<br /> Grand Island, :V'ebraska, as said lot is surveyed, plotted and recorded, and being a rectangular tract of ground
<br /> having a Westerly frontage of 60 feet on Oak Street and a depth of 66 feet bounded on the North by the alley
<br /> in said Block, subject or.ly to an easement in favor of the c�wners of that part of Lot Five (5} lying and
<br /> abutting the above described re�.lestate on the South f or stxch sewer pipe, line or conduit naw running under
<br /> the surface of said i�ortherly 60 feet of said Lot Five (5) as it now and for more than ten years la.st past
<br /> has been in actual existence, and further subject to the tenancy of Fd Kenoyer to that portion of the dwelling
<br /> house now siti�ated on said demised premises now occupied by him, he having agreed to vacate the same on or
<br /> before June 1, 1952, the buyer te receive a11 rents accr�eing from and. after date of final settlement of the
<br /> purchase price under this contract;
<br /> together with all and singular the tenemen±s, hereditaments and a�purter.ances thereunto belonging or in any wise
<br /> appertai.ning; and also all the estate, right, title, interest, property, possessi�n, claim and demand whatsoever, which
<br /> the said Testatrix had in her lifetime, and at the time of her decease, and which the said party of the first part has
<br /> by virtue of the said Last Will and Testament, or otherwise, of, in or to the above granted premise� and every part
<br /> and parcel thereof with the a.ppurtenances; it being the inter.tion of all parties hereto, that in the event of the
<br /> death of one of said secand parties, the entire fee simple title to sa.id real estate above described shall vest in the
<br /> survivor of them;

<br /> thereof, unto the said second parties an3 to their assi.gns, and to the survivor of said second parties, and t o the heirs

<br /> And the said party of the first part, for herself, her heirs, executors and administrators, does hereby covenant,
<br /> promise and undertake to and with the said parties of the second r�rt, and their assigns, or to the survivor of them,
<br /> and to the heirs and assigns of sucb. survivor, that she islawful�ly,�he- execut.�riar�the Last Will and Testament of the
<br /> said Anna Kluge, and has po�+rer to convey as af oresaid, and has in all respects acted, in making this conveyance,
<br /> in pursuance of the authority granted i.nan.d by the said Last Will and Testament, and that she has not made, done, or
<br /> suffered any act, matter of thing whatsoever,since she was F,xecutrix as af oresaid, whereby the above granted premises,
<br /> or any part thereof are, shall or may be impeached, charged or encumbered in any manner whatsoever, excepting only
<br /> as hereinbef ore sta,ted.
