<br /> KNOW ALL :MEN BY THESE PRESENTS: That we, Dent Z. Holcomb and Helen Holcomb, each in his and her o�,m right and as
<br /> spouse of each other, of Hall County and State of Nebraska, in consideration of the sum of ONE DOLLAR and bther valuable
<br /> consideration in hand paid by Billy W. Morlong and Dale R. Bartz of Hall County, and State of Nebraska do hereby grant,
<br /> bargain, sell, convey, and confirm unto the said Billp W. Morlong and Dale R. Bartz the f ollawing described premises,
<br /> situated in the County of Hall, and State of Nebraska, to wit:

<br /> subject to the following conditions and restrictions, each and all of which shall be and remain in full force and
<br /> effect as covenants running with the land for the time hereinafter set forth, namelp:
<br /> 1. Lots 1 to 10 inclusive shall be known and described as, used and sold only for residential purposes.
<br /> 2. No building shall be moved onto any of said Lots numbered 1 to 26 inclusine without the owner of such lot
<br /> first procuring the written consent bf all owners of all lots in t�Holcomb+s Highwap Homes" Sab-division.
<br /> 3. No building shall be erected or placed on any of Lots 1 to 2? iMClusive in said Sub-division closer than 35 feet
<br /> frora the front of the Lot on which such building is to be erected or moved, front meaning the side of said Lot facing
<br /> North so far as Lots 1 to 10 inclusive are concerned, and front meaning the side of said Lot facing Ea�t. so far as
<br /> Lots 11 to 27 are concerned. "
<br /> 4. No noxious or offensive trade or activity shall be carried on upon an�► Lot in said Sub-division rtor shall
<br /> a�thing be done thereon which may be or becc�mae an annoyance or nuisance to the neighborhood. -
<br /> 5. No basement, tent, shack, gara�e, barn or other out-buildir�g placed upon or erected in said Sub-division
<br /> shall at any time be used as a residence temporarily or permanently.
<br /> 6. No dwelling costing less than $6,500 shall be permitted on any of the Lots nwabered 1 to 10 inclusive in
<br /> said Sub-division.
<br /> ?. No pers on of any r�ce other than the White or Caucasian race shall reside in any building or on any Lot in
<br /> said Sub-division excepting that this covenant shall not prevent occupancq bq domestie servants of a different race
<br /> residing with an o�wner or tenant of said premises thereon.
<br /> 8. No swine nor sheep shall be kept or maintained on any of the premises in said Sub-division.
<br /> 9. No cesspools shall be permitted on any of the premises in said Sub-division, and all owners of said premises
<br /> shall dispose of sewerage on their respective premises in said Sub-division only bp the use of septic tanks or other
<br /> enclosed chemical disposition or sewerage.
<br /> 10. Al1 sidewalks built on any of the premises in this Sub-division running along the front of any Lot in said
<br /> Sub-division shall be constracted along the front edge thereof.
<br /> 10-A. Said Dent Z. Holcomb hereby restricts the use of the West 60 Feet of said Lot Sixteen (16) exclusively for
<br /> residential purposes, which restriction shall be enforceable only by said Dent Z. Holcomb, his executors, administrators,
<br /> devisees, legatees or he irs.
<br /> ---2-- 11: These covenants are to run with the land and shall be binding on all parties and all persons claiming under
<br /> them until May 1, 1963, at which time said covenants shall be automaticallp extended for successive periods af ten
<br /> years each, unless by vote of a majority of the then owners of the Lots in said Sub-�ivision it is agreed to change
<br /> said covenants in whole or in part.
<br /> 12. If any owner of any of the Lots in said Sub-division, or their heirs or assigns, shall violate or attempt to
<br /> violate any of the covenants herein, it shall be lawful for any other person or persons oa,mmin� any real property situated
<br /> within said Sub-division to grosecute any proceedings at law or in equity against the person or persons violati.ng or
<br /> attempting to �iolate any such conenants and either prevent him or them fran so doing or to recover damages or other
<br /> dues for sach violation.
<br /> � 13. Invalidation of anp one of these covenants by judgment or Court Order shall in no wise affect anp of the other
<br /> provisions and covenants herein contained, which shall remain in full f orce and effect.
