<br /> An Ordinance authorizing and directing the sale of certain real estate belonging to the City of Grand Island, Nebraska,
<br /> providing the manner in which the same shall be sold and the terms of said sale;provi ,�'or the giving of notice of the
<br /> sale of the said real estate and the terms of such sa1e; and providing for the right to file a remonstrance against the
<br /> sale thereof.
<br /> WHEREAS, on the 1?th day of March, 1943, the mayor and council passed and approved Ordinance No. 1948, directing,
<br /> authorizing and confirming the sale of the real estate described as
<br /> A parcel of land known as Andersan Avenue extended into Block 3, First Artistic Homes Addition, to the City of
<br /> Grand Island, Nebraska, and theallep north from Anderson Avenue to Phoeni.� Avenue, described as folloWS:
<br /> Beginning at the S outhwest corner of Anderson Avenue, going east alon¢ the South line of Anderson Avenue, a distance
<br /> of 156 feet to the West line of California Avenue; thence North 60 feet along the West line of California Avenue;
<br /> thence West 140 feet along the North li.ne of Anderson Avenue; thence North 318.85 feet along the East line of the
<br /> alley to the South line of Phoeni.x Avenue; thence Southwesterlp 18.2 feet along South line of Phoeni.z Avenue; thence
<br /> South approximatelp 436 feet along the West line of the alleg to the point of beginning,

<br /> WHEREAS, Elden Rasmussen is now the awner of the real estate described as
<br /> Beginning at the Northeast corner of Lot Seven (7), Block Three (3), Better Homes Subdivision, an Additio�'ta�he
<br /> Citp of Grand Island, Hall Countp, Nebraska, as now surveyed, platted and recorcied, running thence South fro� said
<br /> point along the East lot line of said Lot Seven (?), �eing the Westerly line af California Avenue, a distance of 56.15
<br /> feet or to the point where the South line of Anderson Avenue as vacated meets the West line of �alifornia Aqenue;
<br /> running thence West along the South line of that p�rtion of Anderson Avenue vacated to a point which is the
<br /> intersection of the South line of Anderson Avenue as vacated with the West line of said Lot Seven (?); running
<br /> thence Northwesterly along the Westerly line of said Lot Seven (7), to the Northwest cor�n�r of said Lot Seven

<br /> Ordinance No. ].948, and becanse of the fact that that part of Anderson Avenue described ,in said Ordinance No. 1948,
<br /> was:�never vacated, there is a cloud upon tt�e title of the real estate belonging to the said Elden Rasmussen, and
<br /> Wf�REAS, on the 7th day of November, 1951, the council of the said City of Grand Island, passed and approved
<br /> Ordina.nce No. 2559, and amon� other things, said ordinance vacated the alley and that part of Anderson Aeenue herein
<br /> referred to, reserving unto itself title to that part of the allep and Anderson Avenue so vacated, and
<br /> WHEREAS, Elden Rasmussen has affered to pay to the �ity of Grand Isla nd the sum of $25.�0 for a Quit Claim De�d in "
<br /> order to clear the title to the real estate belonging to him herein described, and has petitioned the Cit� Council to
<br />� execute and deliver to him said deed for said premises;
<br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of the City of Grand Island, Nebraska:
<br /> SECTION l. That the sale of the real estate described as
<br /> Beginning at the Northeast corner of Lot Seven (?), Block Th�ee (3), Better H�es Subdivision, an Addit�on to the
<br /> City of Grand Island, Hall County, Nebraska, as naw surveyed, platted and recorded, running thence So�th from said
<br /> point along the East lot line of said Lot Seven (7), being the Westerly line of Cal ifornia Avenue, a distance of 56.15
<br /> feet or to the point where the South line of Anderson Avenue as vacated meets the West line of California A�enue;
<br /> rnnning thence West along the South line of that portion of Anderson Avenue vacated to a point which is the inter-
<br /> section of the South line of Anderson Avenue as vacated with the West line of said Lot Seven (?); rnnning thence
<br /> Northwesterly along the Westerly line of said Lot Seven (?), to the Northwest corner of said Lot Seven (?); running
<br /> thence East along the North line of said Lot Seven (?), to the point of ,beginning and being such portion of sai.d
<br /> Lot Seven (7), Block Three (3), Better H�nes Subdivision as was platted on that portion of Anderson Avenue.
<br /> to Elden Rasmussen, be, and the same is hereby directed, authorized and confirmed.
<br /> SECTION 2. The terms of such sale are as f ollaws: The said Elden Rasmussen has agreed to pay to the City of Grand
<br /> Island the sum of Twenty-five ($25.00) Dol]_ars for a Quit Claim Deed for said �bremises in order to remove a cl oud from
<br /> the title to the same and the City of Grand Island shall not be required to furnish an Abstract of Title. �
<br /> SECTION 3. As provided by law, notice of such s�rle and the te�ns thereof shall be published for three consecutive
<br /> weeks in the Grand Island Daily Independent, a newspaper published in and of general ci.rculation i� said City of Grand
<br /> Island, imnediately after the passage and publication of this ordinance, and the City Clerk is hereby directed and
<br /> instructed to prepare and publish said notice.
<br /> SECTION 4. Authority is hereby granted to the electors of the Citp of Grand Island, to file a remo�tstranGe against
<br /> the sale of the within described real estate; and if a remonstrance against the sale signed bp legal electors of said
