<br /> WHEREAS, the said Laura E. Meyer, wife of the said �ry ;f, Meyer, died on Februarp 21, 1945; and
<br /> WHEREA�, the said Henrq J. Meyer died on December 17th, 1949, a citizen and resident of Hall County, Aiebraska,
<br /> and that he left a last will and testament, which has heretofore been admitted to probate in the County Court of
<br /> Hall County, Nebraska, which probate has never been set aside or appealed from, and which last will and testament
<br /> contained, among others, the following:
<br /> ��III- - - -(e) Mp said Trustee shall have authority to sell anp and all properties, of which
<br /> I may die possessed, during the termination of this trust, except farm land owned bp me in
<br /> Merrick County, Nebraska, and as trustee, shall have full power to make, execute and deliver
<br /> such deeds or bills of sale or other instruments, as may be necessary to convey the title to
<br /> any real or persanal property so sold, without any order of the court.��
<br /> AND, WHEREAS, the said Vernon Rice is now the duly appointed, qualified and acting Trustee by virtue of the
<br /> orders of the County Court of Hall County, Nebraska, of the trust estate of the said Henrp J. Meyer, deceased; and
<br /> WHEREAS, the County Court of Hall County, Nebraska, in the trust estate o�' the said Henry J. Meyer, did on
<br /> the 16th day of March, 1951, enter an order as follows:
<br /> i�IT IS, TNEREFORE ORDERED, ADJUDGED AND AECREED by the Court that Vernon Rice, Trustee, be and he is hereby
<br /> authorized and directed, as Trustee, to make, execute and deliver to Roq Q. Robb a Warranty Deed to the following
<br /> described property, to-wit:
<br /> «The Southwest Quarter (SW4) of Section Twenty-two (22), in Township Eleven (11) North, Range Ten
<br /> (10), West of the 6th P.M., in Hall County, Nebraska,
<br /> upon payment of the balance of the purchase price to him.r'
<br /> NOW, THEREFORE, i VF.RNON RICF., as Trustee of the Estate of the said Henry J. Meyer, deceased, of Grand Island,
<br /> Hall County, Nebraska, in consideration of the sw�n of Ten Thousand Dolla�"S($10,000.00), of which the sum of $3049.50
<br /> has heretofore been paid, leaving a balance of $6950.50, the receipt of which balance in hand paid is hereby acknow-
<br /> ledged, do hereby grant, bargain, sell, conveq and confirm unto ROY Q. ROBB the following described real estate,
<br /> situated in the County of Hall and State of Nebraska, to-wit:
<br /> The Southwest Quarter (SW4) of Section Twenty-two (22), in Township Eleven (11) North, Range Ten (10), West
<br /> of the 6th P.M.,
<br /> Together with all of the tenements, heredita�nents, and appurtenances to the same belonging, and all the estate,
<br /> title, claim or demand whatsoever of the said grantor of, in or to the same, or any part thereaf, subject to taxes,
<br /> if any, which may have become a lien against said premises since Janaarq 21, 1946, and subject to any other liens
<br /> or encumbrances that may have been placed thereon or suffered to be placed thereon by the grantee, and subject to
<br /> right-of waq easement to American T�lephone and Telegraph Company, recorded in Book T, page 235, in the office
<br /> of the Register of Deeds of Hall County, Nebraska.
<br /> TO HAVE 2WD TO HOLD the above describ�d premises, with the appurtenances, unto the said grantee, and his heirs
<br /> and assigns forever, and I, the said Vernon Rice, as Trustee� do herebp covenant with the said grantee named herein,
<br /> and with his heirs and assigns, that, as trustee, I am lawfully seized of said pr�mises; that they are fre� fro�n
<br /> encumbrance ecept as stated herein, and that I, the grantor, as Trustee, haee good right and lawful authority to
<br /> sell the same, and that I, as Trustee and my successors, as Trustee, shall warrant and defend the same unto the
<br /> grantor named herein, and unto his heirs and assigns forever, against the lawful clai.ms of a11 persons whomsoever,
<br /> excluding the exceptions named herein.
