<br /> WHEREAS, Samuel L.Rife departed this lii�e testate on the 10�h day of July, 193�; that the wi11
<br /> of said deceased was admitted to probate in the County Court of Ad�ms County, Nebraska, as required
<br /> by law, which order probating said will was unappe�.3ed from and t:ne same is in full force and
<br /> effect; that on the 25th day of August, 193�, this court made and entered an order appointing
<br /> the undersigned, Walter A.Knicely, as the executor of said will and estate, and he h�.s been act-
<br /> ing in �hat capacity since; that at the time of the death of said deceased he owned a nnte dated
<br /> November 1, 1931, due November l, 19�1, signed by Elizabeth Kindig, and secured by a mortgage on
<br />, the Southtaest Quarter (SW�) of 3ection 26, Township 9, North, Range lO, West of the 6th P.M. , Hall
<br /> County, Nebraska; tnat thereafter said Elizabeth Kindig d�faulted in the ma�ter, and this court
<br /> made and entered an order authorizing the executor to commence an action of foreclosure, which he '

<br />' did in the District Court of Hall County, �Tebraska, and on the 7th day of 5eptember, 1940, the
<br /> sherif f of Hall County, Nebra.ska, under order from the District Court of' that county, r�ade and
<br /> executed a deed therePor to the executor, who has since held it in his name as�ex�cutor.
<br /> That on the 9th day of July, 194i, this court made and entered an order authorizing and empower-
<br /> ing �he undersigned as executor to make, execute and deliver a deed to same to E. H.York, for the
<br /> sum of �3200.00;
<br /> NO��, THEREFORE, I, the duly appointed, qualified and acting executor of the wi11. and estate of
<br /> Samuel L.Rife, in con5ideration of the premises and the sum of' �3200.�J0 to me in hand paid by E. I�.
