<br /> KNOW ALL MEN BY THESE PRESENTS THAT:
<br /> WHEREAS, in an aetion of partition pending in the District Court of Hall County, where Edwa.rd
<br /> L.Rich and Jessie M.Rieh, his wife; Doro'Chy Lepant and Joseph Lepan�, her husband; Frances Spanel
<br /> and Ernest Spanel, her husband; Margaret Price and Louis M.Price, her husband; Isabel Ham11n and
<br /> Harold Hamlin, her husband; Ma$ien St�.11 and Loy Stall, her husband; and Joseph Wagner, unmarrie d
<br /> were plaintiffs and Joanne Rich, a minor, � Josephine Rich, mother and guardian of Joanne Rich; and
<br /> Josephine Rich were d�fendants for the partition of tne premises hereinafter descl�ibed, the under-
<br /> s3.gned referee, a�po�.nted by said court to make partition of said real estate, made report in
<br /> writing, duly signed, setting forth that partition of said lands could not be made without great '
<br /> pre,�udice to the owners thereof, which report was duly examined by said Court, and said Court being �
<br /> satisfied therewith confirmed the same, �,nd thereupon made an order and caused the same to be en-
<br /> tered, directing me aa said referee to sell said premises for cash on confirmation of the sa.le and
<br /> directed euch s�le to take place at the front door of the Hall County, Nebraska Cour� HouBe,
<br /> And in pursuance of said order I caused a notice to be published in the Grand Island Daily
<br /> Independent, a newspaper printed a.nd in general cireulation in Hall County, that I would offer
<br /> said real estate, hereinafter described, for sa.le at the front door of the �ourt House in said ,
<br /> County on the 1�4th day of September, 1940, at ten o ' clock a.m. of said day, and at such time and
<br /> place stated in said notice, and after said notice had been published for more '�han thirty days
<br /> I offered said lands, to-wit :
<br /> Lot Four �4) in B1ock Eighteen (1�) , in Charles wasmer' s Addltion to the City of
<br /> Grand Island, Hall County, Nebraska.
<br />' for sale at public auction, and sold the same to Loy E. Stall and Ma,xien Stall and to the survivor
<br /> of them aa ,joint tenants and not as tenanta in common for the sum of �300.00, they being the highest
<br /> bidders therefor. And afterwards, on the 25th day of September, 1940, said Court approved and
<br /> confirmed said sale, and by order directed me as said referee to exeeute to said Loy E. Sta11 and
<br /> Maxien Stall a.nd to the survivor of them as ,joint tena.n�� and not as tenants in eommon a deed con-
<br /> veying said lands to them in fee simple.
<br /> NOW THEREFORE I, Harry Grirnminger, referee, in consideration of the premises and the sum oP
<br /> �300.00, so bid and paid by Loy E. stall and Maxien Stall, and by virtue of the powera vested in
<br />' me by law, do by these presents grant, sell, and convey unto the said Loy E. Stall and Maxien Stall
