<br /> 4. ACTIO�IS AFFECTIN(3 TRUST ESTATE. Trustor shall appear in and contost a��y
<br /> act�on or pmceeding purpurting to affect the security hereof or the rights or powers of Beneficiary or
<br /> Trusteo,and shall pay all costs and expenses,including cosu of evidence of title and attomey's fees,in
<br /> any such sction or proceeding in which�eneficiary or Trustee n�ay appear. Should Trustor fail to
<br /> make any payment or to do any act as in the manner provided in any af the Laan Instruments,
<br /> Beneficiary and/c�r Trustee.each!n tts own discredon,withottt obligation,may make or do the same in
<br /> such manner and to such extent as either may deem necessery to protect the secur(ty hereof. Trustor
<br /> shall,immediately upon demand therefor by Beneficiary,pay all cost�and axpenses incurred by
<br /> Heneficisry in connection with the exorcise by Beneficiary of'Qiie foregoing rights,includIng,without �_
<br /> limttarion,costs of evidence of tttle,couR costs,appraisats,surveys and attomey's fees. Any such
<br /> costs and expenses not paid within ten(10)days of written demand shall draw interest at the clefault �,
<br /> rate pravtded in the Note.
<br /> 5. EMINENT DOMAIN. Should the Trust Estate,or any part tf�ereof or interest therein,be
<br /> taken or damaged by reason of any public improvement or condemnarion proceedin�,or in any other
<br /> manner including deed in lieu of Condemnldon("Condeynnation"),or should Trustor receive any
<br /> notice or other information regarding such proceedin�,'Trustor shail give prompt written notice
<br /> therco'Fto Benaficisry. Beneficiary shall be entitled to all compensation awards and other payments or __
<br /> ���t�r���FQr��^n�t�nAtt I�e entitled to mt�lce any compromtse or settlement in conneciion with such
<br /> d rights of actlon and proceeds awarcicu io

<br /> further assignments of the Proceeds as Beneficiary ot Trustee may requlre.
<br /> 6, pppO1NTMENT OF SUCCESSOR TRUSTE�E• Beneficlary may,from time to ttme,by
<br /> a written instrument executed and acknowledgeci by Heneficiary,mailed to Trustor and recorded in the
<br /> County in which the Trust Estate Is locatcd and by otherwise complying with the provis{ons of the
<br /> applicable law of the State of Nebraska substitute a successor or successors to the'frustee named
<br /> herein or uaring 6►creunder. _
<br /> 7. SUCCESSORS AND ASSIG S. This Deed of Trust applies to.inures to the benefit of
<br /> and binds all parties hereto,their heirs,legatess,devisees,,�ersonal representatives,successors and
<br /> - assigns. 'Che Term"Beneficiary"shall m�1n the owner and holder of the Note,whether or not named
<br /> as Beneficiary herein.
<br /> 8. MSPECTIONS. Deneficlazy,or its agents,representatives or workmen,are authorized
<br /> to enter at uny reasonable t3me upon or in any parc of the Trust Estatc far tlie p�s�of inspecting th�
<br /> sa�ne and for the purpose of p$rformii�g any of the acts it is authorized to perform under tha terms of
<br /> any of the Loan instruments.
<br /> g, FV�NTS OF DE�A_ULT• Any of the following events shafl be deemed an event of
<br /> � default hereunder:
<br /> - (a) Trustor shall have failed to make payment of any installment of interest,principal,or
<br /> _ principal und interest or any other sum secured hereby when due;or,
<br /> (b) the�e has occurred a breach or default under any term,covenant,agreement,condition,
<br /> - provision,representation,or warranty contained in any of the Loan Instrumenu. _
<br /> _ (c) If Trustor shall sell,convey,transfer.or dispose of the real property described in the Note
<br /> securing the debt cvidertced by the Note.nr any part of such property,or any intemst therein,or agree
