<br /> wherein Hans Lueth and Hazel Lueth, were plaintiffs, and Elizabeth Wegner, Fred We�ner, �ldine
<br /> Dalton, James Dalton, �rnest -Lueth, Leon Lueth, Janiece A. Lueth, James L. Lueth, a minor, and
<br /> Robert W. Lue�h, a minor, and all persons having or elaiming any .interest in the North Fif�y Feet
<br /> of the �outh One Hundred Feet and the East One Hundred Ninety �ight and Six-tenths feet of the
<br /> South Fifty Feet of Block Three, Koehler �ub&ivision, being a part of the southeast Quarter of
<br /> the Southwest Quarter and p�rt of Lot Fourte�n of the County 3ub-Division of the �V'est I�aIP of
<br /> the Southwest Quarter all being in �ection Fifteen, Township �leven, North,Range Nine,Hall County,
<br /> Nebraaka, real names unknown, were defendants, for the partition of the premises hereinafter
<br /> described, being Case No. 11068, the undersigned Referee, appointed by said Court to make partition
<br /> of said real estate, �ade report in writing, duly signed, setting forth that partition of said lands
<br /> could no� be made without great pre�udic� to the own�ra thereof, which report was duly examined
<br /> by said Court, and said Court being satisfied therewith, confirmed the same, and thereupon made
<br /> an order and caused the same to be entered, directing me as said Referee to aell said premises
<br /> on the fol�owing �erms, to-wit : at public sale as upon execution at the North front door of the
<br /> County Court House in Grand Island, Hall County, Nebraska, the terms of sale being 15� cash and
<br /> balance upon confirmation; abstract of title to be furnished purchaser up to date of sale showing
<br /> alear marketable title to said premises.
<br /> And in �ursuance of said Order, I caused a notice to be published in the Grand Ialand Daily
<br /> Independent, a legal newspaper printed and in general circulation in Grand Island, Hall County,
<br /> Nebraska, that I would offer said landa for sale at the North front door oP the County Court
<br /> House 3n Grand Island, Hall County, Nebraska, on the 5th day of June, 194�8, at 2 o� cloek P.M.
<br /> . of said day, afl.d at the time and place atated in said notice, and after said notice had been
<br /> published for more than thirty �.ays, i offered said lands, to-wit : the North Fifty Feet of the
<br /> �auth One Hundred Feet and the �ast One Hundred Ninety Eight and Six-tenths feet of the South
<br /> Fifty Feet of' Block �hree, Koehler Sub-Diviaion, being a part of the Southeast Quarter of the
<br /> SouthVrest Quarter and �art of Lot Fourteen of the County Sub-Divi$ion of the West Half of the
<br /> Southwest Quarter all being in 3ection Fifteen, �ow nsh3.p �leven, North,Range Nine, Ha11 Cou nty,
<br /> Nebraska, for sale at public auction, and s�ld the sazne to Hans Lueth and Hazel Lueth, hus�and
<br /> and wife of each other, as �oint tenants, and to the survivor of them, - for the sum of Five
<br /> Hundred Dollara (�50�.00) , they being the highest bidders therefor. And afterwards, on the 12th
<br /> day of June, 19�8, said Court apnroved and confirmed said sale and by an order directed me as said
<br /> Referee to execute �o said Hans Lueth and Hazel Lueth, husband $nd wife of each other respectively,
<br /> ae �oint tenants and not as tenants in common, or to the survivor thereof, a deed conveying said
<br /> lands to them as �oint tenants, in fee simple.
<br /> NOW, THEREFORE, I, Arthur C. Mayer, Referee, in consideration of the premises and the sum of
<br /> Five Hundred Dollars (�500.00) so bid and paid by said Hans Lueth and Hazel Lueth and by virtue
<br /> of the powers vested in me by law, do by these presents grant, sell and convey unto the said
<br /> Hans Lueth and Hazel Lueth as �oint tenants,_ and not as tenants in comu�on, and to their assigns,
<br /> or to the heirs and assigns of the survivor of them, forever, the real estate being deacribed
