STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth <br />the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the <br />following described improvement which will infringe upon an easement dedicated to the Licensor: <br />To install pier foundations for containers as required by City of Grand Island Building <br />Department, per attached sketch. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the following <br />described real estate subject to the Licensor's easement to which this License Agreement shall apply: <br />Lot One (1), Spelts-Schultz Industrial Subdivision, in the City of Grand Island, Hall <br />County, Nebraska; the centerline of the easement and right-of-way being more <br />particularly described as follows: <br />Commencing at the intersection of the easterly line of the Northeast Quarter (NE %<), Section <br />Twenty-four (24), Township Eleven (11) North, Range Ten (10) West of the 6 P.M. and the <br />northerly line of the Union Pacific Railroad right-of-way; thence southwesterly along the said <br />northerly line of the Union Pacific Railroad right-of-way a distance of one thousand forty-one <br />(1,041.0) feet; thence deflecting right 90°00'00° and running northwesterly a distance of two <br />hundred fifty (250.0) feet to a point on the northerly line of a�ract of land described in Document <br />#79-005899, recorded in the Hall County Register of Deeds Office, and being the actual Point of <br />Beginning; thence deflecting right 35°18'24" and running northerly a distance of one hundred <br />fifty-five (155.0) feet; thence deflecting left 84°30'06" and running northwesterly a distance of <br />sixty (60.0) feet. <br />The above-described easement and right-of-way containing a total of 0.079 acres, more or less, <br />as shown on the plat dated 12/23/94, marked Exhibit °Afl, incorporated herein by reference. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. <br />The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, <br />agents and independent contractors for any damage or injury that may result to said improvement.
