However, such lazzd may be usod, <br /> and any rigrts otherwise acquired b� this oonveyance ma� be <br /> exercised, as if no reservation of sucY: materials had beeri <br /> mado; except that, when such use results in the extraction of <br /> any s.uch �aterial from the land in quantities which r�a;� not <br /> be transferred or delivered without a license under the �tor:iic <br /> Energy Act of 191�6, as it no�v e�cists or may heroaftor be <br /> amended, such material shall be the property of the United <br /> States Atomic Energy Commission, �nd the Cor,imission m�y requi.re <br /> delivery of such material to it by any possossor thareof after <br /> I <br /> sucli material has been separated as such from the oros in <br /> which it :vas contained. If the Commission requires the <br /> delivory of such material to it� it shall pay to the person <br /> mining or extrrzcting the same, or to such other parson as the <br /> Commission determines to be entitled thereto, such sa.ms, <br /> including profits., as the Commission doem3 fair and reasonable <br /> for the discovery� mining, development, production, axtraction, <br /> e <br /> and other services' performed �vith respect to such r�aterial <br /> i prior to such dolivery, but such payment sh€zll not include <br /> �ny amount on account of the value of such mutorial be�oro <br /> removal from its pla�o of deposit in nature.
