<br /> THIS DEED, made this 24th day of October, 1953, by and between
<br /> Bayard H. Paine, Jr. , of the County of Hall, and State of Nebraska,
<br /> as executor of the Last Will and Testament of Cassius R. Conger,
<br /> deceased, .late of the County of Hall, and the State of Nebraska, party
<br /> of the first part, and genneth Brink and �ildred I�eyer Brink, husband
<br /> , and �iife, as JOINT TENANTSy and not as tenants in eommon, of the County
<br /> of Hall, and State o� Nebraska, parties of the second part;
<br /> WITNESSETH, that the said partv of the f irst part, the duly
<br /> appointed, quall�ied and acting executor of the estate of the said
<br /> Cassius R. Conger, deceased, under his Last �fill and Testament, whieh
<br /> is of record in the office of the Probate Court o� Hall County,
<br /> Nebraska, by virtue of the power a.nd authority granted and conferred
<br /> upon him, under the said will, and by virtue o� the further power,
<br /> au'thority, approval and order of the County Court of Hall County, .
<br /> Nebraska under date of October 5, 1953, and in consideration of the
<br /> sum of E�GHT THOUSAND FIVE HUNDRED and NO/1p0 (�8, 500.00) DOLLARS,
<br /> to him paid by the parties of the second part, the receipt whereof
<br /> is hereby aaknowledged, does by these presents grant, bargain, sell,
<br /> remige; release, con vey and confirm unto the said parties of the
<br /> second part, and to their heirs and astiigns forever, a11 of the follo�v-
<br /> ing described real estate, situated in the County of Hall, anc� State
<br /> of Nebraska, to-wit:
<br /> Fractional Lot Five (5), in Block Six (6), in S�aulding and
<br /> Gregg�s Addition to the City of Grand Island, Hall County,
<br /> Neeraska, and complement; to-wit: a part of Lot Eight (8),
<br /> of the County Subdivieion of the Southeast Quarter of the
<br /> Southwest Quarter (SE4Sj'P�) of Section Sixteen (16), mownship
<br /> Eleven (11), North, Range Nine (9), �4est of the 6th P.Id. , in
<br /> Hall County, Nearaska, which together with said Fractional
<br /> Lot ,� makes a full Zot of 66 feet fronting on First Street
<br /> and 132 feet deep along the Easterly side of Jefferson Street,
<br /> in said City of Grand Island, Nebraska;
<br /> together with a11 and singular the tenements, herec�itaments and appur-
<br /> tenances thereunto nelonging or in anywise at�pertaining; �.nd also all
<br /> the estate, right, title, interest, propert;�, possessian, claim and
<br /> demand. whatsoeeer, which the said testator had in his liPetime, and at
<br /> the time of his �ecease, and which the said varty of tre first part
<br /> has, by virtue of the said Last Will and Testament, or otherwise, of,
<br /> in, or to the abo ve granted p remises, and every part and pa�cel thereof,
<br /> with the appurtenances.
<br /> IT BEING THE INTENTION OF 1�I,L FARTIES HERETO, THAT IN THE 1�'VENT
<br /> OF THE �EATH OF EITHER OF SAID GRANTEE9, THE EATTIRE FEE S�.PLE TITLE
<br /> TO THE REAL ESTA`"E DESCRiBED HEREIN SHALL VEST IN THE SURVIVI?�iG GRANT�E.
<br /> T� �HAVE AND TO HOLD the said above described premises, with the
<br /> hereditaments and appurtenances thereof, unto the said parties of the
<br /> second part, their heirs and assigns, forever.
<br /> And the said party of the first part, for himself, his heirs, exec�-
<br /> tors and administrators, does covenant, promise and undertake to and with
<br /> the said parties of the second part, their heirs and assigns, that he is
<br /> lawfully the execator of the Last GPill and Testament of the said Cassius
<br /> R. Conger, deceased, and has power to convey as aforesaid, and has the
<br /> additional power by approval of the County Court o�' Ha11 County, Nebraska,
<br /> as aforesaid, and has in a11 respects acted, in ma.king this conveyance,
<br /> in pursuance of the authority granted in and 'by the said Last 4i'iI1 a,nd
<br /> Testament; and the authority and apnroval oP said County Court; that he
<br /> has nQt made,, done or suffered any act, matter or tring whatsoever, since
<br /> he was executor as aforesaid, whereqy the above granted premises, or any
<br /> part thereo�, are, shall or may -oe impeached, charged or ineumbered, in
<br /> any:manner whatsoever.
