�o�io��90 <br />other Lot on which the Party Wall is located, for party wall purposes, including mutual support, <br />maintenance, repair and inspection. In the event of damage to or destruction of the Party Wall from any <br />cause, the Owners, at their joint expense, shall repair or rebuild said Party Wall. Each Owner shall have <br />the right to the full use of any Party Wall so repaired and rebuilt. Notwithstanding anything contained <br />above to the contrary, if the negligence, willful act or omission of any Lot Owner or its agent, employees, <br />customers or invitees, shall cause damage to or destruction of the Party Wall, such Lot Owner shall bear <br />the entire cost of repair or reconstruction. A Lot Owner who by its negligent or willful act causes the Party <br />Wall to be exposed to the elements shall bear the full cost of furnishing the necessary protection against <br />such elements as well as the cost of repairing any degradation and damage to the building or its <br />com ponents. <br />7. Maintenance, Ta�ces and Insurance on the Lots. <br />7.1. Maintenance Responsibilities of Lot Owners. Each Lot shall be maintained by the <br />respective Lot Owner in accordance with this Declaration, including the Rules and Regulations attached <br />as Exhibit B. The cost of maintenance shall be the separate responsibility of each Lot Owner, and shall, <br />include, without limitation, the following ("JMCA"): <br />7.1.1. Repair and replacement, as necessary, to the roof and structural portions of Lot <br />Owner's portion of any building on its Lot; <br />7.1.2. Maintaining and properly striping the parking areas and access areas, and the <br />surtaces in a level, smooth, and evenly covered condition with the type of surfacing material <br />originally installed or such substitute as shall in all respects be equal in quality, use, and <br />durability, including any temporary repair of potholes, curb breakage, damage to parking <br />bumpers, if any, and to any paving and thereafter the permanent repair of same; <br />7.1.3. Placing, keeping in repair, and replacing any necessary or appropriate <br />directional signs, markers, and lines with respect to the operation of the Lot Owner's <br />business on the Lot; <br />7.1.4. Operating, keeping in repair, and replacing, where necessary, such artificial <br />lighting facilities as shall be reasonably required with respect to the operation of the Lot <br />Owner's business on the Lot; <br />' 7.1.5. Maintaining all perimeter and exterior building walls, including, but not limited to, <br />all retaining walls in a good condition and state of repair, windows (including sashes, frames, <br />locks and hardware) and all exterior building signage (including replacement of signs); <br />7.1.6. Maintaining, watering, mowing, weeding, trimming, and watering all landscaped <br />areas and making such replacements of shrubs and other landscaping as is necessary and <br />as may be directed by Developer; <br />7.1.7. Keeping in force and effect a public liability insurance policy; <br />7.1.8. Removal of snow and ice from walkways, access ways and parking areas within <br />the Lot; <br />7.1.9. All trash and rubbish containers located on the respective Lots for the use of <br />permittees shall be emptied on a sufficiently regular basis and shall be washed at intervals <br />sufficient to maintain the same in a clean condition; and <br />5 <br />Meadowlark Declaratlon <br />Lots 1 & 2-9"' Subdivision <br />
