<br />TRUSTEE'S DEED
<br />This instrument, made this 't % day of September, 2011, between Eric H.
<br />Lindquist, a member of the Nebraska State Bar Association, Successor Trustee, hereinafter
<br />called "Grantor ", pursuant to a power of sale contained in that certain Deed of Trust recorded
<br />on February 9, 2005 as Instrument No. 0200501150 in the office of the Register of Deeds of
<br />Hall County, Nebraska, and Colonial Savings, F.A., hereinafter called "Grantee ".
<br />WHEREAS, on July 30, 2010, Grantor, executed a Notice of Default pursuant to
<br />which notice was given to Joel B. Shafer, a single person, Trustor, under that certain Deed of
<br />Trust recorded on February 9, 2005 as Instrument No. 0200501150 in the office of the
<br />Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />Block Three (3) in Ponderosa Lake Estates Subdivision in the City of
<br />Grand Island, Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and
<br />setting forth the nature of such breach and of his election to sell or cause to be sold such
<br />property to satisfy the obligation. Said Notice of Default was filed for record in the Office of
<br />the Register of Deeds of Hall County, Nebraska, on July 30, 2010, as Instrument No.
<br />201005325.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. 676 -1008.
<br />Subsequent thereto, beginning on July 5, 2011, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and
<br />stating that the described property would be sold at public auction to the highest bidder for
<br />cash or certified or cashier's check, at the lower level lobby of the Hall County Courthouse,
<br />1st & Locust Street, Grand Island, Hall County, Nebraska at 2:00 p.m. on August 18, 2011.
<br />Publication of such notice was made for five consecutive weeks on July 5, 2011, July 12,
<br />2011, July 19, 2011, July 26, 2011 and August 2, 2011, the last publication being at least ten
<br />(10) days but not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat.
<br />§76 -1008.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor,
<br />did at the time and place mentioned in said Notice of Trustee's Sale, postpone such sale
<br />pursuant to Neb. Rev. Stat. §76 -1009. Thereafter, at 9:00 a.m. on September 9, 2011, John B.
<br />McDermott, attorney for Grantor, did offer said property for sale at public auction, and did
<br />sell the same to Grantee for the sum of $265,000.00, it being the highest bidder therefor.
