Upon execution of this Deed of Trust Assumption and Modification Agreement, the Assuming Party hereby assumes any and all obligations of the Trustor in respect to the Deed of Trust as modified hereby. 2. Provisions of Assum tp ion. The Assuming Party shall hereby be deemed to be the Trustor in the Deed of Trust it being acknowledged by Assuming Party that the Deed of Trust shall continue to secure the same as though Assuming Party had originally joined in the execution thereof. 3. Security for New Instrument of Indebtedness. The indebtedness described in the Deed of Trust from the date hereof secure a Deed of Trust Note in the face amount of SEVENTY-SEVEN THOUSAND FIVE HUNDRED SEVENTEEN AND 21/100 DOLLARS ($77,517.21) of even date herewith, together with all renewals, modifications and extensions thereof and any all future advances and re- advances thereof. 4. Date of Stated Maturitv. The maturity date in respect to the indebtedness to be secured by the Deed of Trust is extended to August 1, 2041. 5. Notice to Assuming Partv. Any notice required in the Deed of Trust to be served upon Trustor shall be served by addressing the same to Assuming Party at 7012 S. 90th Road, Wood River, NE 68883. 6. Continuin Effect. Except as modified hereby, the Deed of Trust shall remain in full force and effect. 7. Bindin E� ffect. This assumption by the Assuming Party shall bind the Assuming Party and his successors and assigns.
