201106667 r SUBORDINATION AGREEMENT THIS INDENTURE,made this 11th day of August, 2011 Between Great Western Bank hereinafter calldd pare of the First Part, and ACCESS NATIONAL MORTGAGE, hereinafter called party of he Second part. WITNESSETH, that whereas party of the First Part is the owner and holder of a certain DEED of TRUST in the amount of $105,816.49, Dated 10/31/06, recorded on 11 /07 /06 „Instr. No 0200609968 as Document encumbering the land situated in the county of Hall State of Nebraska Described as follows: See attached legal Property address: 4107 W. Faidley Ave., Grand Island, NE 68803. WHEREAS Scott & Kathaline Laws BORROWER(S) have made application to party of the Second Part for a loan not to exceed the amount of $166,101.00, to be secured by a First Deed of Trust encumbering the above described premises, and party of the Second Part has required as a condition precedent to making of said loan that the party of the First Part subordinate it's Deed of Trust and the lien thereof and all of it's rights there under to the Deed of Trust to be placed upon said premises as aforesaid, and party of the First Part is agreeable to such subordination. NOW THEREFORE, in consideration of the sum of One Dollar ($1.00), and other valuable consideration in hand paid by the party of the Second Part to the party of the First Part, receipt whereof is hereby acknowledged, and as inducement for making aforesaid BORROWER(S), the party of the First Part does hereby subordinate the aforesaid deed of trust by it and the lien thereof and all of it's rights and there under to the Deed of Trust recorded in Official Records instrument # Book Page , Of the Public Records of COUNTY OF /,4,1/ STATE OF ENCUMBERING THE ABOVE DESCRIBED PREMISES AND DOES HEREBY COVENANT WITH THE PARTY OF THE SECOND PART that is has not transferred as assigned the aforesaid Deed of Trust held by it nor the Promissory Note it secures, nor any interest held by it in either of said instruments, and it executed this Subordination Agreement as tenants by entirety of the entire interest held by it in said Note and Deed of Trust and declared any right of claim held by it to be subject and inferior to the Deed of Trust held by the party of the Second Part and to all rights of the party of the Second Part there under.
