Lender shall give notice to Borrower prior to acceleration following <br />Borrower's breach of any covenant or agreement in this Security Instrument (but not • prior to <br />accelerataon under Section 18 unless Applicable Law provid�s othertimise�, The notice shall specify: (a) the <br />default; (b) the action required to cure the default; (c) a date, not less than 30 day§ from the date the <br />notice is given to Borrower, by which the defaatt must be cured; and (d) that failure to care the defauft <br />on or befare the date speci�ed in the notice may resu[t in acceleration of the sums seeured by this <br />Security Instrument and saie of f.he Property. The notice shall farther inform Borrawer of the right to <br />relnstate after acceleratioa and the right to bring a court action to assert the non-existence of a defanit or <br />any other defease of Borrower to acceleration and sale. If the defaalt is not cured on or before the date <br />specified in the notice, Lender at its option may require immediate payment in fult of all sums secured <br />by th€s Security Instrameut without further demand and may invoke the power of sale and any other <br />remedies permitted by Applicable I.�aw. Lencier shall. be entitled to collecE alI expenses ineurred in <br />pursuing fhe remedies provided in this Section 22, including, but not limited to, reasonabte attorneys' <br />fe�s and costs of title evidence. � � � <br />If the power of sale is invaked, Trustee shall record a notice af default in each county in which any <br />part of Ehe Property is lacated and shall mail copies of sach notice in the manner prescribed by <br />Applicable Law to Borrower and to the other persons prescribed by Applicabls Law. After the time <br />required by Applicable Law, Trustee shall give public notice of sale to tfie persons and in the manner <br />prescribed by Applicabte Law. Trustee, without demand an Borrower, shall sell the Property at public <br />auctian to the highest bidder at the time and place and uader tLe terms designated in the no�ice of sale in <br />ane or more parcels and in any order Trustes determines. Trnstee may postgone sale of atl or any parcel <br />of the Property by public announcement at the time and place of any previously seheduled sale. Lender <br />or its designee may pnrchase the Property at any sale. <br />Upon receipt of payiment of the griee bid, Trustee shall deliver to the purchaser Trustee's deed <br />conveying the Property. The recitals in the Trustee's tleed shall be prima facie evidence of the truth of <br />the st�tements made therein. Trustee shali apply the proceeds of the sale in the fallowing order: (a) fo all <br />costs and egpenses of egercising the power of sale, and fhe sale, inclading the payment of the Trustee's <br />fees actually incurred and reasonable attorneys' fees as permilted by Applicable Law; (b) to all sums <br />secared by this Sacurity Instrument; and (c) any egcess to the person or persons legally entitled to i�. <br />23. Reconveyance. Upon payment of all sums secured by this Security Instrument, Lender sha11 request <br />Trustee to reconvey tbe Pzoperty and shall surrender this Security It�strument and a11 notes evic�encing debt <br />sec�ed by this Security Instrument to Trustee. Trustee sha11 reconvey the Property without wananty to the <br />gersoa or persons legally entitled to it Such person or persons shall gay any recordation costs. Lender may <br />charge such person ar persons a fee for reconveying the Property, but only if the fee is paid to a f.hird pariy <br />(such as the Trustee) for services rendered and the cliarging of the fee is permitted vnder Applicable La.w. <br />24. Substitnte Trustee. Lender, af its op�ion, may from tinae to time remove Trustee anci appoint a <br />successor trustee to any Trustee appointed heraunder by au instrument recorded in the county in which this <br />Se.curity Inshvment is recorded. Without conveyance of the Property, the successor trustee shall succeed to all <br />the title, power and duties conferred upon Trustea herein and by Applicable La.w. <br />25. Request for Notices.
