<br />1. Said Deed of Trust was recorded in the Mortgage Records in the office of
<br />the Register of Deeds of Hall County, Nebraska on July 31, 2007, as Instrument #
<br />0200706520.
<br />2. The Borrower has failed to pay to Lender the sums required to be paid by
<br />the Borrower to Lender pursuant to said Deed of Trust.
<br />3. On or about April 28, 2011, Successor Trustee filed a Notice of Default in
<br />the office of Register of Deeds of Hall County, Nebraska. Said Notice of Default was
<br />recorded as Instrument # 0201103268. On or about May 6, 2011, Successor Trustee
<br />transmitted a copy of the Notice of Default to the Borrower and to alt other persons
<br />entitled to notice, pursuant to said Deed of Trust, by certified mail, return receipt
<br />requested in compliance with 111eb. Rev. Stat. 76-1008.

<br />within 30 days after recordation of said Notice of Default.
<br />5. A Notice of Trustee Sale was executed by Successor Trustee on or about
<br />June 20, 2011. Successor Trustee published the Notice of Trustee's Sale in the Grand
<br />Island Independent, a newspaper, printed and published daily, having a bona fide
<br />circulation in Hall County, Nebraska in excess of 500 copies, once a week for five
<br />consecutive weeks, commencing on June 21, 2011. Said Notice of Sale was last
<br />published on July 19, 2011. At least 20 days prior to the date of sale, a copy of the
<br />Notice of Trustee's Sale was mailed, by certified U.S. Mail, postage prepaid, to all
<br />parties entitled to notice pursuant to said Deed of Trust, in compliance with Neb. Rev.
<br />Stat. 76-1008.
<br />6. At 11:00 a.m. on August 1, 2011, Mitchell C. Stehlik, attorney for
<br />Successor Trustee, conducted the sale of the above-described Property at public
<br />auction. Said public auction was held on the First Floor of the Hall County Courthouse,
<br />111 W. 1 Street, Grand Island, Hall County, Nebraska. Jerry Rapp made a bid of
<br />$37,600.00 at the sale and the same was accepted as the highest bid submitted for said
<br />Real Property.
<br />7. �ucc��s�r Trus�ee coniends that t�e ha� compiied wifh the requirements
<br />of Neb. Rev. Stat. 76-1001 thru 76-1018, in conducting the sale of the Real Property,
<br />held on August 1, 2011.
<br />8. Mr. Whaley, in his capacity as Successor Trustee, hereby grants and
<br />conveys to Jerry Rapp, as Grantee, without any covenant or warranty, express or
<br />implied, all of its title, and all right, title, interest and claim of Grantor, and its successors
<br />in interest, and of all persons claiming by, through or under him, in and to the above-
<br />described Real Property, including all such right, title, interest and claim in and to such
<br />Property acquired by Grantor or its successors in interest subsequent to the execution
<br />of Deed of Trust.
