�0�106027 <br />NON-UNIFORM COVENANTS. Borrower and Lender further covenant and agree as follows: <br />22. Acceleradon; Remedies. Lender shall give notice to Borrower prior to acceleration following <br />Borrower's breach of any covenant or agreement in this Secnrity Instrament (bnt not prior to <br />�cceleration under Secdon 18 unlesa Applicable Law provides otherwise). The nodce ahaII specify: (a) <br />the defanit; (b) the action reqnired to cnre the def�nit; (c) a date, not less than 30 days from the date <br />the notice 3s given to Borrower, by which the defanit mnst be cnred; and (� that failnre to enre the <br />defanit on or before the date specified in the notice may resnit in acceleration of the sams secared by <br />tluis Security Instrament and sale of the Properiy. The notice shall fnrther inform Borrower of the <br />right to reinst�te after acceleration and the right to bring a conrt action to assert the non e�Tstence of <br />a defanit or anp other defense of Borrower to acceleration and sale. If the defanit �ts not car� on or <br />before the date spedfled in the notice, Lender at its option may r�wire immed�tate payment in full of <br />all suma secured by th�s Secnnity Luctrament withont fnrther demand and may invoke the power of <br />sale and any other remedies permitted by Applicable Law. Lender shall be enl3tled to collect all <br />ezpenses incnrred �tn pursuing the remedies provided �in this Section 22, inelnding, bnt not limited to, <br />reasonable attorneys' f�s and costs of title evidence. <br />If the power of sale is �tnvoked, Trastee shall record a no13ce of default in each connty in which <br />any part of the Property is located and shall mail copies of snch notice in the manner prescribed by <br />Applicable Law to Borrower and to the other persons prescribed by Applfcable Law. After the time <br />reqnired by Appl�cable Law, Trastce shall gtve pnblic not3ce of sale to the persons and �in the manner <br />preseribed by Applicable Law. Trastee, withont demand on Borrower, shall sell the Properiy at <br />pnblic anction to the high�t bidder at the t3me and place and �der the terms designated �in the <br />notYce of sale �in one or more parcels and in any order Trastee determines. 1 rastee may postpone sale <br />of all or any parcel of the Property by pnblic announcement at the time and place of any pnwionsiq <br />schednled sale. Lender or its designce may pnrchase the Property at any sale. <br />Upon receipt of payment of the price bid, Trustee shall deliver to the pnrchaser Trnstee's deed <br />conveying the Properiy. The recitals in the 1 rastee's dced shall be prima fade evidence of the trath <br />of the statements made therein. Trastee shall apply the prnceeds of the sale in the following order. (a) <br />to all costs and egpenses of egerdsing the power of sale, and the sa1e, inclnding the payment of the <br />Trustee's fees actaally 3ncnrred and reasonable attorneys' fces as permitted by Applicable Law; (b) bo <br />all snms secared by th�iss 5ecudLy �nstrament; and (c) any ezcess to the gerson or persons legaIIy <br />entltled to it <br />23. Reconveyance. UPon PaYme�'rt of all sums sacured by this Security Inslnmaent, Lend� shall <br />requeqt Trustee to reconvey the Property and shall surrender this Security Instrument and all notes <br />evidencing debt secure� by this Sacurity Instrument to Trust�. Trustee shall r�onvey the Propeciy <br />without warranty to the person or persons legally entitled to i� Such person or P�s � PaY �►Y <br />recordation costs. Lender may charge such person or persons a fee f� recomreying the Property, but only <br />if tha fee is paid to a third party (such as the Trust�) far services rendered and the charging of the fee is <br />pennitted under Applicable Law. <br />24. Snbstitate Trastee. Lender, at its option, may from time to time remove Trustes and appoint a <br />successor trustee to any Tnistce appointed hereunder by an instrument recorded in the county in which this <br />Security Instrument is re�orded. Without conveyance of the Property, the successor trustea shall sucxeed to <br />all the title, power and dirties c�nferred upon Trustee herein and by Applicable Law. <br />25. Reqnest for Notices.
