LICENSE FOR DRAINAGE 2 0� 10 5 6�. 3 WHEREAS, Sylvia McTavish, hereinafter referred to as Party of the First Part, is owner of real estate located in the NW 1/4 of Section 33, Township 11 North, Range 11, West of the 6�' P.M., Hall County, Nebraska; and WHEREAS, Ron Thorne and Jackie Thorne, hereafter referred to as Party of the Second Part, are purchasing the property known as Cedaz Pine Second Subdivision, which is surrounded by the property owned by the Party of the First Part; and WHEREAS, Party of the Second Part has a driveway which abuts the property line of the Party of the First Part and which driveway drains onto the property of the Party of the First Part; and WHEREAS, Party of the First Part is selling the property legally known as Cedar Pine Second Subdivision, to the Party of the Second Part; and WHEREAS, the parties desire to continue to provide for drainage of the driveway to be owned by Party of the Second Part. IT IS, THEREFORE, AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: 1. That Party of the First Part is the owner of Lot 1, Cedar Pines Second Subdivision, and is transferring that property to Party of the Second Part. 2. 'That Party of the Second Part as purchasers of Lot 1, Cedar Pines Second Subdivision, desire to insure that they have drainage of their driveway as it currently exists onto the property of the Party of the First Part. 3. That the Party of the First Part does hereby grant a license agreement for a period of twenty-five (25) years, to provide for the continued drainage of the driveway as it currently exists across the property of the Party of the First Part. 'I'his license agreement shall extend a distance of three feet onto the property owned by the Party of the First Part from the Northeast corner of Lot 1, Cedar Pine Second Subdivision, traversing the lot line to the South and along the lot line a distance of 367 feet. 4. This license agreement is personal only to the Party of the Second Part and the parties can only modify this agreement by mutual agreement which shall be reduced to writing. DATED this day of , 201 l.
