This instrument, made this 11th day of January, 2011, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on November 16, 2004 as
<br />Instrument No. 0200411090 in the office of the Register of Deeds of Hall County, Nebraska, and
<br />the Secretary of the Department of Housing and Urban Development, hereinafter called
<br />"Grantee ".
<br />WHEREAS, on October 15, 2010, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Kevin Keith and Ilene Keith, husband and wife, Trustors, under that certain
<br />Deed of Trust recorded on November 16, 2004 as Instrument No. 0200411090 in the office of the
<br />Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />Lot Five (5), Block Five (5), Dodd & Marshall's Addition to the Village of
<br />Wood River, Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on October 18, 2010, as Instrument No. 201007646.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76 -1008.
<br />Subsequent thereto, beginning on December 1, 2010, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on January 11, 2011. Publication of such notice was
<br />made for five consecutive weeks on December 1, 2010, December 8, 2010, December 15, 2010.
<br />December 22, 2010 and December 29, 2010, the last publication being at least ten (10) days but not
<br />more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76 -1008.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to CitiMortgage, Inc. for the sum of $185,785.45, it being the highest
<br />bidder therefor. CitiMortgage, Inc. has assigned all of its right, title and interest in such bid to
<br />Grantee.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $185,785.45 so
<br />bid and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors
<br />and assigns forever, all the estate, right, title and interest of which the said Kevin Keith and Ilene
<br />Keith, husband and wife, and their successors in interest, were seized or possessed at the time said
<br />Deed of Trust was given, or at any time thereafter, in and to the premises sold as aforesaid, to -wit:
